A question about a name

I'm looking for even slight input on a domain name issue I've been having!

Let's say you know of a pretty large website with a fairly big and super dedicated audience that was abandoned out of nowhere. Everyone's left without a true replacement. There's no chance it's coming back and it gets a lot of exact keyword searches every month.

Do you step on its toes and get a copycat domain (hoping to nab the abandoned when it expires, too), or come up with your own? The abandoned website was a .net and the new copycat domain would also be a .net. The copycat name would also be better and shorter while still reaping the benefits of the original's name.

Doing a similar name has a lot of benefits, including instant recognition, feeling like it is the most legitimate replacement due to the name, nostalgia, easy to find etc. I don't think there's anything legally sketchy about this since it was just a name, not a patented product or something.

The drawback being it is a .net like the original and not starting fresh. But maybe there are more pros and cons I am missing?

It's a dumb question, but it's been bugging me for awhile now and I'm creeping up on the point where I need to make a decision for the new website.

Any ideas?

    This is tough to answer, primarily because it is a legal question. I don't have the details about the old site, of course, but generally speaking someone owns the Intellectual Property Rights to it, and they may nail you if if you try to copy it in name, function, or look and feel. You really should consult an attorney, with all details, about this.

      I'll clarify some more in case, though I'm certainly not expecting legal advice. There might be important info I left out.

      For example, the original site is something like bananaing.net and all it was was a default but niche vBulletin board. I'm interested in getting bana.net (not banana itself, but a nickname of banana) and doing something similar, but a lot more elaborate.

      The original site didn't have a product or try to profit in any significant way, it was purely user generated content, and obviously I'd like to monetize mine eventually...

      No content is being lifted or anything

    I guess it'd be kind of like if warriorforum shut down and warrior.com popped up and had a similar forum to replace it. But on a much smaller scale

      That example is pretty generic, and you would have fewer problems with that since it is not a proprietary name. Still, not an easy call without knowing how close you are to appropriating the good-will and traffic of another site. IMO, this question is not as easy as it looks. Essentially, you are trying to grab the traffic of a similar site (even though you mention it seems to be defunct), and that would be a legal worry.
