US Wrongfully Accuses 80,000 Webmasters of being Child Pornographers

How would you like to wake up one morning and find your personal or business website not only shut down, but having a huge banner on it saying you have been shut down because child pornography is a federal offense?

That is what just happened to over 80,000 website owners:

Story Here

Gotta be careful about putting up free websites on shared domains!

Well yeah you gotta be careful, but I think our wonderful government just made another blunder yet again. So what penalty will DHS suffer? None of course...I just think that unless these agencies really know what they are doing, they ought to learn first or stay completely out of doing that kind of stuff. Who knows how many businesses lost money because of that little blunder.

Anytime the government wants to shut down free speech, they accuse someone of being a child pornographer, a pervert, or rapist.

Look at the wikileaks guy? He was setup by that CIA bitch and accused of being a rapist... did he do it? I doubt...

Our government has a dirty habit of using false accusations to step AROUND the constitution.

Do you honestly believe that they would make such a big blunder? I mean, one or two mistakes.. but 80,000?

Its obvious to me that they had ulterior motives. I would try to see something in common about these websites or even website owners that the government doesn't like... and that would be the real reason they were shut down.

    kindsvater,

Since you're the lawyer here, what are those people's rights?

(I realize that's a very "it depends" type of question)

I'm really surprised they branded it like that - why not just yank it down? It smacks of seeing "Pwnd" on the screen...

(I may be wrong but) I don't think you can sue US government, at least not for these type of errors.

They violated rights - they caused damage to business reputations - they interfered with properly run businesses. Actually they can even file a class act lawsuit, which won't give them much money back but it can make it clear that people aren't going to put up with tyranny.

I'm sure that out of 84,000 people they will reap a few well placed lawsuits. The problem is that the "mistake" has been fairly well spun by their PR department to prevent large masses of people from ever even hearing about it. -- I just tweeted that page and think that others might want to do to the same. It will probably be on FB once I get the chance, too.

How people treat this "incident" will be determined by how they want to be living in the next few years.

I think you can, or it used to be you could. In the 1950's Henry Ford sued the US government because during WW2 they bombed his tank making facilities in Germany and he WON...
If the government ruined me like they did with afraid.org I wouldn't rest until they not only issued a public apology, but paid for damages as well.

Maybe our country needs to be led by people who don't need refresher courses in the importance of due process. Look for more of this crap to happen. People will ignore it. Just like people have already decided that they will keep flying.

This is just the beginning. Supposedly DHS was created to protect the homeland from a terrorist threat but in reality its to keep the people in check.

There is no transparency or accountability in our government.

Zeal obviously does not equate to using ones brains! What a total bunch of IDIOTS! Of course it would effect all those sites, its on shared hosting which is free. Ever single site has the same IP address and name servers.

Sickening, and yeah what happened to due process? Innocent until "PROVEN" guilty? That doesn't exist any more in this country.

Terrifying... I recall a story not long ago about a guy who was accused of this due to having kiddie porn on his work computer ..This man was accused, and absolutely ruined personally, professionally, and financially .. The Feds shredded this guy without mercy ..

It was later discovered (forensics) that in fact, this guys system had been hacked and that all the crap on his system had been placed & being "stored" there by a sophisticated, undetectable "virus" type program ..This program allowed these pedophiles to use this guys system as a "warehouse" for their garbage without any visible indicators ..
The Feds, Lawyers, and media crucified this poor guy only to learn he was completely innocent .. Interestingly enough, they did not pursue apologizing as aggressively as they did condemning him!

I thought you can sue US government only if their action caused a physical harm, such as torture, false imprisonment etc.
Plus, although they did make a mistake, I am not sure if this case would actually qualify as 'violation of rights', simply because they followed the protocol.
I never looked into this, so this is just what I think. But if I am wrong and something can be done by the affected parties, then more power to them!

Absolutely they can take actions against the Fed - Due process is due process, and failure to do so violates the Constitution ..Period! This Judge should be disbarred / removed from the bench for blindly signing such an order!

This is just another classic example of to much Government and a chilling example of their power / ability to interfere / shut down Global communications ..

Where is Paul Revere when we need him? One if by land, two if by sea!

Pedophiles are the government's favorite new boogeyman. Anytime they want to justify further curtailing our freedom on the internet they use pedophiles as an excuse. All they need to do is mention the word "Child Porn" and there are legions of parents groups and religious activists begging the government to shut down the internet.

The hardest thing to do is to launch and support a lawsuit against the government to prove damages, when your business and reputation is in ruin.
