Someone ripped off my sales letter, product and bonuses...advice please...

I have a fairly successful product in the clickbank marketplace. Obviously I have always expected competition (which does sprout up from time to time) however some lazy plagiarizer essentially ripped off my entire sales letter (only reworded slightly) exact format of the salesletter... he even ripped off my bonuses!

I commissioned an artist to design some of the graphics for my ebook and he even took those. They can ONLY be found in my ebook and no where else on the web. Not only that, but he ripped off some of my ebook word for word!

Will clickbank step in if my call them and explain the situation... or should I send a cease and desist to this jerk?

Has anyone had something similar happen?

(just to be clear... he is also selling through clickbank)

Thanks,

Ben

You can issue a DMCA to their host. Info here and sample DMCA to use. The host will tell them to take it down or lose their account.

I would also still report it to Clickbank. Not sure what there policies are about things like this but it wouldn't hurt to let them know. He might have done it to others on the network.

Thanks guys... and thanks for the DCMA notice.

Do you think I should reach out to the vendor before I contact clickbank?

I wouldn't bother warning or even speaking to a thief.

Maybe you should. Just in case he backs off without a fight, and you save plenty of time.

If i were you, i probably would reach out to him and give him a little while to see if he responds. Otherwise ... get him !

I have always thought the best way to beat a thief, is from behind with a baseball bat. No point warning them, it takes the fun out of it.

I recently had a similar problem to yours, and if you follow the advice you have been given in this thread, it will solve your problem.

I would only reach out to the vendor if you can put your fist in his face.

Go to Clickbank and file the DMCA. Why speak to them? They're thieving idiots.

You need to document a claim to the thief and to ClickBank. ClickBank is usually good about terminating accounts. But you do not want to see this seller continue operating through paydotcom, e-junkie, etc.

To the jerk you need so demand a product take down and payment of all revenue they received.

And you should be on the US copyright office website TODAY submitting your product and graphics for copyright protection.

I had someone from italy do this back in the day and he had the nerve to even put my copyright on it! One legal letter from a lawyer friend to the guy stopped it - but as a few have said, you can now file the DMCA.

I have no agenda but to help those in the same situation. This I feel will pay the bills.

Also don't forget to report it to the other person's hosting company as well. Many hosting companies don't want to be caught in the middle of any copyright anything nowadays.

This is my greatest IM fear!

What measures can we take to prevent this, or is it just apart of the gig?

Firstly, Ben, how did you find out someone out there stole your work?

How should we go about checking from time to time if someone has stolen our content?

I reported the violations to clickbank through email and will follow up via phone on Monday.

I am going to file a DCMA notice to his hosting on Monday and also send him a cease and desist on Tuesday.

When he checks his inbox Tuesday morning... it should be interesting lol!

I wish I could find that ***hat in person.
