Legal risks...be careful where your hyperlink goes...

I'm not an attorney...but that's what I understood from an email I got from Mike Young...

from what I've read it seems that if you hyperlink to a site with content like child pornoghraphy or illegal online gambling you migh be get in some legal trouble...even if when you set up the link that site wasn't about child pornoghraphy or illegal online gambling...

So you should check often where your links go...make sure that you are not linking to such sites that could get you into legal trouble...you never know sites change...domains switch ownership...

    That email from Mike Young is part of a WSO thats been floating around lately. Also, it should be pointing out that gambling online is not illegal. It is only illegal to transfer money from US banking institutions to these sites under false pretenses. So, Luckily for 99.999% of affiliates, this isn't a likely scenario.

    After all, I highly doubt my Amazon and CB links will suddenly start leading to child pornography. :rolleyes:

    True that, but at the end of the day we can't really control who posts our websites and where. So a legal claim seems a little harsh to me.

  • I'm sorry but I always find these types of topics entertaining. Because they are usually, what a friend of a friend told someone, that he heard from some guy that wasn't an attorney.

    The LAST thing you should be doing is taking any type of legal advice from anyone who is not an attorney. And if you have any doubts, then contact an attorney that you have on retainer that will be the one that will represent you if you get into any legal trouble.

      This doesn't seem to be anything new for me under German legislation. There is a standard disclaimer where you tell your visitors that you checked the links at the time you added them and that you dissociate yourself from them.

      I just don't know where the legal boundaries are there, because some clearly illegal sites try to put themselves in a gray zone with this disclaimer way. They tell "we don't host the files here, we just collect the links" and try to get away with it. I think you should just be careful to what you link to in any case.

      So true. Even if you link to a good page, and it is later changed to something illegal, it is easy to prove the changed happened after you made the link.

      It is a worry why so many people are into scaremongering. Why do they waste their time spreading such information? So-called "gurus" damage themselves every time they bring up questionable things like this. All you can really ask is, "What are they selling now?'

    This is silly. I don't think they can hold you liable for a link you have posted to a website unless you are in fact advertising that illegal content, and if you are, shame on you.

      Actually DHS thinks they can, and its not just pedo or gambling sites either, its any site that participates in illegal activities, including streaming illegal things like the superbowl.

  • Re reading the post again, yes there is certainly some gray area and of course it varies from country to country. But for instance, in the US in the past couple years they have changed the laws so that if you link to say a copyrighted material you can be found liable for contributory copyright infringement. But of course this applies only to the current laws on the book in the US.

      What??? There is no formal provision for contributory infringement in U.S. copyright law according to Contributory copyright infringement - The IT Law Wiki and other knowledgeable sources. "Contributory infringement" is not a law and it's not relevant.

      Some companies may have tried to twist patent law into a "contributory infringement" argument in regard to copyright, but it's a stretch and it has nothing to do with linking.

      Best to get a real legal opinion rather than rely on some of the strange notions that appear on this forum.
