Got a nice email from someone looking out for me - one of my eBooks was being promoted by a scummy site that points them to a rapidshare. FYI Warriors - he has a WSO section too. For $50 or so you can access all of it - my products, WSOs, other people's products, etc. His site motto is something like why pay for marketing products when you can have it all for one price?

So I email the guy telling him to take it down. Quit promoting that, etc.

He tells me to F&%@ myself.

I tell him I'll happily report it, etc.

His answer?

As far as I am concerned, because I ain't hosting the file on my site there is shit you or anybody can do. First of all, why did you even join my subscription ? sounds like to me you are now part of this site, and I have all the proof I need because you have downloaded a few of the post on the site. You see I track every bodies IP, how many times they are on, how long, what they clicked on.....Just to give a little hint, this site is up to catch people like you. This site is an undercover site by the internet police institution.<<

I never joined his site - someone else sent me the email he sent out. And I never downloaded anything from his site, either so he's bluffing.

But the point is...

The nerve!

Not only are you a damn thief, but you have to be rude about it, too? No remorse? Well now you've just pissed me off. And it's probably some weaselly loner who weighs no more than 80 pounds soaking wet. I just WISH I could see him face to face - they sure are big fer their britches behind a monitor aren't they?

        They will probably remove it, but you could be chasing yourself in circles with this one. It can be re-upped under a different name or onto a site similar to rapidshare.

      You can probably get them to take it down pretty easily. The only issue someone else will load it up or they will put it on a different account. They will also get tricky and require a pw to unzip the file and change the name. I don't think Rapidshare can track all that.

        Yeah, Rapidshare's pseudo-anonymous. The most you could accomplish would be for them to disable the links and disable his account if he's a paying member. Then he would just sign up under a different name.

        You're on the right track with going after his hosting and paypal.

        Think of him as a burgler. Going after only the rapidshare links is like trying to lock each door after he's been in through that door. His site and payment processor are his hideout - burn it down. He can start up again, but he's not making money in the meantime. It happens enough and he'll decide to either stop altogether or at least put you on a banned list since you're such a headache.

    Here's another funny part: "this site is up to catch people like you"

    I haven't seen the scumbag's site, but it's quite possible an honest person could see it and not know they were downloading something illegally.

    And what "police" organization would send an obscene response to someone they should be protecting.

    Is this guy charging money? Report him to his payment processor.

    Also report him to his registrar and host. The fact that your files were apparently on a server he didn't own doesn't clear him. He is still illegally distributing your work.

    Sounds like some pimply faced 13 year old to me. Lol, internet police institution, that cracks me up.

    Sorry your product is being shared around illegally. That is the worst and the best thing about the internet. Everything is just bits and bytes when it comes down to it and if unethical people get a hold of your stuff, they can distribute it freely. But our ability to distribute things freely as internet marketers is what is so awesome. Guess you have to take the good with the bad.

    You can take solace in that anybody who downloads it for free wasn't ever going to buy it anyway, so you really aren't losing business.

    yes, contacting the hosting company in my case worked WONDERS for me - I guess I should be relieved that the guy who had my ebook on his site apologized once I got his site taken down. Wow. What a complete low life dirtbag.

    Hey Tiff,

    I think I know the very guy. He still sends me e-mails to join his download network. The way I got sucked into one of his previous schemes was, he sent me an e-mail to the address I only use for PayPal & Ebay. He said he was a famous Guru (whom I just had purchased a program from, so it appeared legit) offering a personal coaching program deal. He was only offering it to 5 people (Ha!) and it was only $100. His guarantee was, "if you aren't making at least $100 a day, everyday, within the first week, I will refund your money."

    So I joined up. Talk about Black Hat! I was really questioning the ethics of the Guru, when I get an e-mail from THE REAL Guru saying, "Beware, someone is pretending to be me and selling personal coaching..."

    The very day I got that e-mail, the fake guy sent an e-mail saying "I never said I was THE Guru, we just have the same name. He then changed his contact e-mail to "admin" instead of the guru name.
    (he actually mentioned that he is a member of the WF, himself!)

    I contacted the payment processor and complained. (no action). I then emailed them again, with the real Guru's e-mail, asking me to go to the authorities, and I got a refund the same day.

    As for Rapidshare taking the link down...they will do it, but someone can just repost it with a new link (happens all the time), so you are fighting a loosing battle. They have every major release on the market and every WSO.

    The only good thing that came of this was that part of this guys instruction was to get on the WF and build-up my feedback score. He never did tell me how that was going to be used in his master plan. He mentioned getting my post count up to 10. I think he was aiming at me posting a WSO.

    He suggested doing "Oh yea, I agree" posts to build up quickly. Anyone who has followed my posts knows, I've NEVER done that. I'm too long winded for that . And, just in case anyone is wondering, I've never advertised in my Sig File or done a WSO (soon to change, though )

    I had been lurking for some time, and I'm glad I did follow THAT instruction and become part of the family.

    Sorry Tiffany, you will have a hard time getting these people (and Torrent sites, too) from stealing your work.

    But, I like that you are going to the bad guy's hosting company. He will just change companies, but you will inconvience him, temporally.

    If ebook publishers had any idea how many times their works are getting passed around for free, they wouldn't be able to sleep at night. Piracy has been a HUGE problem since the beginning of personal computing.

    Tiffany, have you considered using a protection package to secure your ebooks? I know, they're not 100% effective, but they will slow down some percentage of illegal users.

      Yes, his site should be yanked and frankly it's a shame that it is so hard to criminally prosecute these cases. What he is doing is no different than stealing your books from a bookstore and giving them away.

      Tiffany, if you know the dirtbag's name you should report him to the admins. And maybe there's a way to get his site taken down - if we could find out what products he is giving away illegally then the individual authors could complain.

        I sent a message to help desk - not sure if this is the way to report it or not. Just in case

        Everyone always forgets about this site but the FBI handles cases like this:

        I have spoken to them and they DO handle theft of digital downloads like this. And yes, I do plan to report his site - right this second in fact!

    I tried to get this individuals paypal account shut down too, but no luck as yet. He always manages to be one step in front of the game.

    He's now hosting on a dedicated server, hidden his info and has loads of false information out there.

    There are more than one of us trying to oust this cretinous moron.
    If I could get him down that dark alley well there's no telling what I'd do to him.

    I have allerted a few warriors whose products are on the site, but there are too many for one individual to do alone.

      So far the history is -

      Over 9 or more websites - everytime one gets closed down, he or even she just uploads the stuff and starts again with a new website, new hosting whatever they need. They just literally move on.

      Now, they are using a dedicated server with protected who is information.
      Yes I have emailed the guarding company with proof. I await their removal of name protection.

      I have tracked through the rapidshare download link and found who the end provider really is, (because basically this cretinous moron doesn't even have the files they just link to filesharing sites links.)

      I know have all the information I need for my product, I have their screen shots, their Companies House information and Names and Addresses.
      And I am about to take action. COURT ACTION.

      But none of that will help others because the end provider to their product download might not be with the same site I have found.

      You know what makes me perhaps madder than just the guy stealing stuff and getting a way with it?

      There are legitimate people selling things online, such as eBooks or other digital goods and even sometimes physical goods, and they may have spent weeks or months putting something together to sell online. Then, they may get their account closed by their payment processor for "suspicious" activity or whatnot, or they may lose their domain to their domain registrar through the spam extortion method or other means, and so on. And, then, in some cases, they're toast--not because they were scammers, but because they were scammed or tricked themselves or just an innocent victim of a competitor or someone out to have some "fun" or just because someone was too lazy to unsubscribe to a list they subscribed to and instead reported the message as spam, which probably took more effort than unsubscribing but that's another story...

      Meanwhile, the real scammers and thieves seem to have no problem starting up again and again, getting new payment processing accounts, and so on.

      It just seems like it's easier to get a legitimate business shut down than it is to get a scammer taken down.

        That's because the scammers KNOW they're going to be shut down. They keep organized backups and have a contingency plan for when it happens. When a legit businessperson who simply hasn't considered these things has something happen - it's just absolute shock.

        One thing we can learn from these scumbags is to be prepared for our sites to be attacked and have a plan to keep doing business.

    I'm sure Bev can find the guy. If she can't, I'm sure there's someone on the forum who was a private investigator in their previous life.

      Believe me we've shut him/her down more times than the dog can run for the stick!
      He or she is like the boomerang! keeps comming back.
      Paypal doesn't want to know. (well they earn money from the fees so why should they! - that's my account closed now )

      Hosting providers just move on and let it go! onto the next hoster .........

      Dedicated server hosters gaurd their customers like they are gold!
      And Privacy Protectors don't even bother responding in a timely manner!
      so there is no chance you could act swiftly and get illegal things like this stopped. They don't give one iota about the you's and me's, they only care about their bottom line.

      It's sad that 12 months of my hard time working on some script has been stolen and someone else is earning money for stealing it.

      Lessons have been learnt or taught whichever way you want to look at it.
      1. Always make sure your software is licence protected.
      2. Always make sure your ebook is password protected.
      3. If you can't afford the above 1 or 2 make sure whatever you offer has viral links in it. (I learnt that from Sara Brown)
      Hopefully one day, all this Bar steward will be doing is time!

    From what I know, cus I researched this thing abit, if you want to take legal action about this guy, you have to prove that HE actually stole the product and that now he is reselling it.

    If he just found them on other websites and he is reselling them there isnt much you can do, especially if he is not hosting the files on his hosting account.

    He could just say in court or whatever: "I just sold the info, not the actual products"...meaning that he arguments his action something like a journalist, he just sold you the link and not the copyrighted products.

    So, I guess the only way is to just keep closing his hosting, autoresponder etc...

    EDIT: you should also protect your files, download links etc... better, so they would have a harder time hacking your site.

      All they have to do is buy the product, download it, get a refund, and upload the file onto one of those sites - like they did. I don't think it's a protection thing, although I applaud Dr. Mani for cluing me in on a very funny trick to use against those who find your files and steal them - maybe he'll sell that guide one day - it was fun!

      No one hacked my site, they just stole mine and others products and are selling them on to others.

      I guess there will always be theives and those that condone their actions, but it won't stop the rest of us who would like to believe that good wins over evil.

    Wooo, wooo...calm your horses I never said I was ok with them, Ive had my first product stolen too, witch was a wso here, and I found it on of those sharing sites and decided I should do something about it.

    I managed to suspend the website, then I asked a friend of my dad who is an attorney in USA...and he told me that there isn't much you can do besides the above stated because in order to prosecute him for piracy you actually have to prove that he bought the product and resold it or his IP hacked your site and took the product, quote "In court all that matters are evidences, if their not clear...with a decent attorney he will get away with it very fast".

    Thats why I said those thing...I hate them with a passion too, but if I can't prove that HE actually acted against my copyright without me knowing, you cant really give him a big @#$ fine or some time in jail.

    NOTE: I'm not sure how experienced that attorney is, I just stated what he told me.

    I've got proof, screen shots, who is info, and limited company information downloaded, all time stamped.
    I also now have the name of the person I need to claim damages from. The end of the line in my case, is just 3 hours drive away, so if they pull the I want it held in my local court room, no worries. And I don't need an attorney because I know how the legal system works in this country.

      Most definately are in the UK and I've got their Limited Co information, screen shots of the download with their website in the title bar etc....... got it all time stamped and sealed.

      If I hand it to the Met, what good would that do me or my business partner? We have lost money here, wouldn't it be better to go to the County Court and get a judgement against this Co.?
      At least that way one day we would get some recompense.

      If we hand it over to the Met, it becomes something completely different and no compensation will be paid for our losses.

      Or have I got that wrong?

        You are innovative enough to identify a market, tap a demand.

        You are creative enough to write an ebook or infoproduct.

        You are smart enough to market your work and earn money from it.

        Why are you getting anxious, frustrated and upset that someone
        "stole" it now?

        Why aren't you directing that emotion towards your biggest
        assets - and finding SOLUTIONS that will prevent it happening,
        or if it does, will BENEFIT you down the line.

        Think about this...

        * given a choice, 9 out of 10 people will do the RIGHT thing, not
        the wrong thing - most just don't know better

        * you won't make your fortune selling one ebook or infoproduct.
        Sorry if that burst any bubbles, but that's a fact

        * you can create a SERIES of ebooks/infoproducts on the same
        topic of your current ebook - and sell them to anyone who has
        READ your first (regardless of whether they paid for it - or NOT!)

        Hope this gives you enough clues to start working on finding
        PRACTICAL solutions to digital piracy.

        Yes, Tiff, I agree. It's time I made my guide available for
        sale - and I hope someone passes it around, because I'll end
        up making MORE money from that!

        Here in the U.S. people can be pursued both criminally and and in civil court. I would think it would be the same there! I'd love to see people like this in jail.

    I have no idea what the Met would do. The problem is even if you get a county court judgment would they pay the amount they are told to pay?

    I personally would talk to the Met, get their take on it, and see what advice they give.

    Tiff, hit them where it hurts, report them to Clickbank, Amazon, Chitaka and the other ads they have on the site.

    I wouldn't go that far if it was a kid...a big big fine yeah, but if hes younger than 20 years old I wouldn't send him to jail...I just don't have it in me, to take maybe the most beautiful years of his life...

    But thats just me...
