how would this work?

i'm in CA where likely amazon will cease their affiliate program. could i still sign-up as if i'm in a different state? is there some kind of work-around? how would one go about this?

another sub-question would be, if so, what would be the ideal state? one where the legislation has failed to go through (like nevada) or one with no sales tax (like oregon)?

another question: how stable is the amazon program / laws in the remaining state? is it very likely that in the foreseeable future all of the states will have this problem?

BTW, here's a good-looking resource on this issue, with a map and all: Commission Junction - News & Events

About the only way to work around it would be to establish an independent business entity, like a corporation, in your state of choice. Trying to "sign up as if you're in a different state" could be construed as tax fraud or tax evasion. You could be relocated to a graybar hotel of the government's choice.

If I had to look for an alternate location, I'd look for two things - a state without a current sales tax AND where instituting one would take a constitutional amendment.

Before you go through the trouble and expense of setting up a new business entity just to be an Amazon affiliate, spend the money on a good lawyer or tax advisor who can give you the complete picture of what you are contemplating.

[Disclaimer: statements of opinion, not a lawyer, and any other CYA statement that will keep me from being sued.]

I think you can use it in every state. All you need is for Amazon to approve the affiliation with your website - should be on your own domain.

I'm an Amazon affiliate in California, and the state has been going at it against Amazon regarding this tax issue for the last 2-3 years.

It has been vetoed several times because of the huge number of affiliates (10,000+) which arguably would result in far greater loss in incidental state revenue (affiliate income tax, local spending, etc) than it is missing from tax on internet sales.

IMO, it is unlikely to happen in California anytime soon. But, my bets are leveraged in flexibility of preparing to quickly jump over to other affiliate programs such as CJ which do offer similar products.

Sorry, that's nonsense - in regard to what the OP asked.

If you are not familiar with certain sales tax issues that affect affiliate marketing (like being an Amazon associate) in some of the US states... you should NOT post in this thread.
