Affiliate Commissions not being paid!

I hope this thread is in the right place to begin with, if not I apologise and a moderator can kindly move it to the correct place.

I was wondering if any knowledgable warriors could help me here. You see I recently promotted a product/service for a large online organisation and yesterday (May 18th) I was promised my affiliate commissions totalling $1500.00 for this period.

Today is the 19th and I still haven't receievd the commissions, no email nothing! Not only that when I logged in I noticed that they refunded a large commission of mine after the agreed 30 day money back gaurantee period had expired.

I have contacted them and have been awaiting a reply but I wanted to get in here and find out if they can legally do this?

You see it was made quite clear on the sales page and in their affililate material that once the 30 money back guarantee period had expired then cutomers could not claim a refund (this is not a clickbank product by the way). So I ask myself why they allowed such a large commission of mine to be refunded on day 35 without any email to myself to explain they just took it out and still haven't paid me remaining commissions.

What can I do about this? I did write and say I expected to see that commission back in my account and paid to me as the guarantee had expired but I actaully expect them not to do this so was looking for a heads up if there is a legal body I can contact about this, should this be the case.

This was a massive launch and the product creators to my understanding made millions but this would not had happened if it wasn't for us affiliates driving leads and sales to them.

I think some of these product and software creators forget that some of their affililates like myself make a living out of being an affiliate and need to feed out families and expect our commissions to be paid out to us on time and in full.

Especially as I spent 2 months writing blogs post, forum posts and offering up to date support to my bonus claimers as well as making videos for them to help them use the product in question and then they take my affiliate commission and dont pay the rest. My bonus claimers even said that my support was 10 times better than the product's support!

Please does anybody know who I can contact if they refuse to pay or put the commission back into my account? I don't want to let this rest and let them just walk away as I worked really hard creating an entire 2 month campaign for this launch and this is not the first time they have let me down as earlier in the month they sent me the wrong commission report which caused all kinds Of confusion. This launch has made them millionaires but are refusing to pay commission so I don't want to let them get away with this.

BTW, I won't mention the product name or creator(s) yet until I have heard back from them but if I don't get the reply and results I expect I will be happy to lift the lid to save others from such dissapointment.

Again if anyone could point me in the direction of where I could get help with this matter I would be very greatful indeed!

    It is possible that the refund out of your account was a chargeback, even though the company may have a 30 day money back guarantee, my experience with payment processors such as Visa and Mastercard, is that a buyer could request a chargeback up to 90 days (and in rare circumstances, longer).

    Nevertheless, if it was a chargeback by the credit card company, the affiliate company should be willing to share that information with you to prove that it was a legitimate chargeback and to avoid the appearance of impropriety.

    If the company fails to provide you with sufficient evidence and you have no other recourse, you can consider a civil suit against them to recover your commission and costs. I am not familiar with the laws of your country, however, in the USA, any one experiencing this problem can make a legitimate claim in a small claims court.

    That being said, may I present you with an opinion of my own, You stated you spent countless hours producing content, video and blog posts for the sole purpose of this launch. You may find it more fruitful in the future to concentrate on spending your time and energy on a product of your own.

    If you are promoting another persons product without an assured guarantee of being paid, you risk wasting valuable resources, which could easily be expended in your own venture.

    I did the same thing you did, when I first started internet marketing and the exact situation arose wherein a well-known IM refused to pay my commissions. I handled the situation by threatening a lawsuit, to which he eventually did pay me.

    Then, I spent the next 3 months building my own online business from the experiences I had gained in working as an affiliate for that IM guru.
    After all, why build a business for someone else when I can build one for me?

    Obviously, you already know enough to be able to secure a nice commission by promoting someone else's product, you should give it a shot in promoting one of your own.

      Hi Joe,

      thanks for the info your provided. I actually do create my own products I have several online as I have been doing this for a few years now.

      But I have also been a successful affiliate for the last 6 months by promoting products with reviews and bonuses and offering unlimited support. The product in question is a really high end piece of kit which is why I promoted it due its extensive reputation, infact if you are in the IM niche you would most probably of heard of it.

      They are based in the USA I am in the UK so I am not sure how I would go about taking legal action against them. Their support for affiliates of a product that has made them millions is really so poor I expected so much better.

      I was given a simple script to begin with in which to see my affiliate commissions and then they eventually uploaded a proper affiliate database. In all my time as an affiliate I have not had this treatment from product owners and didn't expect it from such reputable product creators.

      If they have authorised the refund I can't see them giving me my commission out of their own pocket but at the same time why should I lose out, if it states 30 days then thats what it should be or they should at least make it clear that you should not spend your commission until at least 90 days has elasped for chargebacks, I am now seriously out of pocket as this was a very large commission.

      I hope there is a way I can take action especially as they have not even paid me my other commissions on the date they stated which was supposed to be yesterday. I really don't want to let them get away with this, I feel like 2 months of my life has been wasted! Dramatic I know, but I want to stop people like this before they do it to others!
