Can a vendor sue me for this?

Hey warrior's, I was wondering can a vendor sue me for taking pics from his site that doesn't has his water mark on it.

I mean that's pretty generic stuff like a marble statue, I mean can he sue me for putting the same product on my site?

Why not just get some pictures from istockphoto.com?

They've got lots of high quality images, and you can purchase marketing rights to them for $1.

This is a small price to pay for peace of mind. Besides, you might even find something that looks nicer for your site...

Greatness is difficult to appreciate from close up. The great mountain on the horizon is only the ground when you are standing on it.

Can I come in your house and take your television? I mean, it doesn't have your name on it, right? And it's just a generic tv. No big deal, right?

The online world specially in IM is too sensitive for copyright issues these days, it is smart to just avoid any action that would get you in trouble for this matter....In a competitive world, hardwork and uniqueness pays off... Good Luck

For generic photos, there is also a good chance that he doesn't own the rights to them either and the original owner can come after you.

The water mark has no bearing on it. That is just a means to catch the person who stole the image and prove ownership.

If you are selling their products, I am pretty sure they will give you permission to use the image. Just ask them. Of the tens of thousands of products that Amazon has for sale, they let their affiliates use their images from what I understand. I am not sure if Amazon owns those images or the manufacturer. But if you are selling their product, it is in everyone's best interest to have all the tools to make the sale, which includes the image. So just ask them.

For copyright infringement, statutory damages start around $25,000 or so. Do you want to risk that?

If you are marketing the vendor's products, ask for permission. I sell stuff from other vendors, and when I asked permission, they pretty much said I can take photos from their website or any print materials they have.

If you are not marketing the vendor's products and just using the pictures to dress up your site or whatever, don't. Get permission first. But, in such a case, it's probably easier to license photos from stock photo sites.

Dan's content is irregularly read by handfuls of people. Join the elite few by reading his blog: dcrBlogs.com, following him on Twitter: dcrTweets.com or reading his fiction: dcrWrites.com but NOT by Clicking Here!

Dan also writes content for hire, but you can't afford him anyway.
