How I got my Amazon California Associate Account Back in Half Hour

It's not that hard guys... we're making way too complicated...

ALL you need is a physical address outside of the state and change it in Amazon. Then call them to tell them you relocated. The guy on the phone was HAPPY to do it for me. They are encouraging affiliates to change out of state address.

No bank account, phone number, LLC or even IP address changes needed. Just change your address. Took me half an hour and I even got sales from the previous few days!

They may send you a verification, so make sure your address is legit and you can get the code.

While that looks good on the surface, when Amazon 1099's you and the State of California requests more information from you regarding your State of residence being California and your income reflecting sales through Amazon don't be surprised if you haven't fooled them.

    That's not legal advice, btw.

Not advised. The tax boys in California don't take too kindly for this stunt. Once you are caught, there will be hefty fraudulent tax filing penalties. So before making this permanent, you need to get competent legal advice.

I plan to pay taxes. I don't see the problem if you file it accordingly.

If you live in California, it is difficult to establish legal residency in another state; they do have various in-state residency requirements. Come income tax filing time, there is going to be a whole lot of Amazon affiliates in deep trouble for operating in violation of Amazon's TOS and the nexus tax laws. There are legal options to avoid these liabilities, but requires legal counsel.

You guys all have a point. I'll have to take further measures.

However, this is a very quick stop gap in the meantime while I research and set things up.

Thanks for the tips. (not legal advice

I'm just glad I live in Iowa and my government shut down the nexus law.

The one thing that you can do is just set up a company outside of California. Once you have the llc it does not matter where you are working from since you are just an employee. Your company would then be responsible for the taxes that are made, and you for the pay you receive. It is a little more trouble but it does avoid a lot of the hassles. (not legal advice, I would still check with an attorney, but I am planning for it here since Texas is trying the same little game)

I am thinking about setting up LLC in NV.

I heard you had to pay $800 franchise tax for an entity outside anyway...

I wonder what other benefits of having an out of state LLC would serve? (since I am doing it anway..) I am thinking about funneling some of my other revenue into NV LLC if there's actually a tax advantage.
