Is it illegal to send autoresponder confirmation after sale

What up everyone. Couldn't really find the exact answer and I am a bit confused. I was always under the impression that a site visitor had to enter their information into an opt-in box before you sent the opt-in confirmation for them to confirm.

Is it possible to auto-send this to the customer when they buy your product (physical or digital)?

So essentially when a customer buys said product they are added to your list, but still need to confirm. Is that possible and more importantly is that legal?

    Possible.

    The confirmation part depends on the list's setup: if it's single optin > no confirmation mail. If it's double/confirmed > confirmation mail goes out.

    Just a few examples where you can do it:
    - aweber + paypal > see the email parser setting in aweber
    - WSO pro > you can add your mailing list data in the setup page
    - RAP (in two different ways)
    - Digiresults

    You do not need permission to contact a paying customer. You already have a business relationship. Any contact related to the purchase, i.e. upsells, related products, etc., is perfectly legit.

        That will certainly depend on your payment processor, your AR, their integration (or the lack thereof) - in other words: the question is too technical to get answered without all the details.

    Whether it is possible depends on your email / autoresponder software.

    Keep in mind, at least in the US, you can send email without first confirming someone wants to receive it. The CAN-SPAM law primarily prohibits deceptive, unsolicited commercial emails. It does not prohibit any unsolicited email, and certainly not a message relating to a purchase made by your new customer.

      Ok, I just got off the phone with Aweber and they stated that its perfectly fine to add the customer to your list after they make a purchase, however, they require a opt-in confirm?

      Now I'm seriously confused, but thank you for your reply.

        I guess you are mixing two different things:

        Aweber (and others) make it possible to add subscribers to your customer list (e.g. getting their email from paypal - see my first post here) without filling out an optin form.

        However, the list itself requires that they confirm their subscription.

            What I have found to be very effective is to have the opt-in form on the thank-you page after purchasing, ie subscription incentivized by OTO, bonuses, and updates, etc. Conversions are significantly higher on subsequent promotions. You may perhaps do a split test.

    This is related to a similar discussion about adding people to your list after they purchase a WSO. I wondered if buying a product, including a WSO meant I could be put on someone's list even if I didn't specifically opt-in. Some people were complaining that they were being forced to opt-in to access a product. From what's being said here, however, it sounds like they wouldn't even have to do this -they could just put you on their list. To me, as a customer, it's not a big deal either way, as long as there's a way to opt-out. Since people have differing views on this, though, it's probably a better business practice to request an opt-in rather than just put someone on your list without asking.
