Creating and charging a product which someone offers free (name only)

Anyone see any problems with the following?

There is a product called X
They offer it for free

I create a product called X (same as other above)
I charge a Price

SOLD ONLINE

From what I can tell the name is not trademark.
The products are completely different.

Anyone see any problem, as , my site will probably out rank theirs in the search engines?

    If the products are completely un-related, then I don't think it will create any problems e.g.

    If your product is rebrandable software

    and their product is an e-book on how to feed elephants.

    Then I imagine customers probably wouldn't get muddled up, or get the free product instead of yours.

    If it is easy for you to change the name of your product, then maybe it would help to not to confuse any really stupid people.

    I like your software store btw, keep up the good work!

      I don't understand that. Are the products the same or not?

      If you're worried, why not just call your product Y? Then there's no confusion and you won't lose customers who find the original product X and choose that one in the belief that it is the same as yours but free.

    I don't think there would be any problems legally, but even if you're products are in totally different domains, some customers might still get confused. Though, if you will rank higher than them, the people looking for the free one might buy yours accidentally

    Thanks everyone.
    I don't see any issues as these are 2 complete different products.
    I have already started getting purchases from search engine traffic so already paid itself off and should rank 1st place (or just stay where I am).

    If it helps, I used micronichefinder and googles keywords and found a gulden nugget with this, so I suspect there are many more...
