Legal issues around using images

Quick question

I want to post an image on my new book or website

What if I can't find this image in any of those Stock sites. I find it on a random website, and the website owner doesn't reply to any of my emails.

As a last resort, can I either copy the image by drawing an almost exact replica, or even copy the image, change things around a bit on photoshop, and then post it on my site?

This is assuming there are no conditions of usage on the website, so one should assume full copyright protection is in force.

Now, would it be legal to do the above, and - being a lil cheeky here - can I get away with it?

No it's the other way around. If not expressly indicated that you can copy and use an image, you can not.

Modified image is still the same image. It is definitely not legal.

Whether somebody will catch you and sue you, is another matter.

Unfortunately it's not legal but a good way to find some images you can use is to go to google and search for keywords relating to your topic.

Then click the "images" link and this will reveal all the images. Then go to the advanced area and click both the boxes that say:

"Only images labeled for reuse. Conditions might apply.
Also limit to images labeled for:
    Commercial use
    Modification"

You can use any of these images.

Or use photo stock images but check the copyrights or you can email the owner of some images. Good luck!

I'd find an artists on Warriors for hire, Freelancer, Fiverr, etc to create a new image. There are many good artists available for small projects like this.

Didn't realize that option was available, thanks. Unfortunately neither option yielded any results for my particular search :s

It really depends on the keyword or the niche... some have more... some have less.

Do not assume any rights to the media just because of the absence of verbiage. You need to have the legal backing up a copyright license that tells you what you can and cannot do.
