If you use an email on the website listed as their contact email, and you simply offer them your service I don't see why it would be a problem. If you randomly collect emails and start sending them constant offers then that is more along the lines of spam.

You must convey the commercial intent of your email in the subject field and you must provide a link for the recipient to opt out of receiving any further emails from you.

Anything can be reported as spam. I can't tell you how many SEO offers I get for my domains. Any website I have that has a contact form get's used as "Spam Bot" to send me SEO offers, etc.

Many website owners report these offers as spam. The fact that you think it's pertinent to them doesn't mean it won't get reported as spam.

To limit the amount of people that report your email as spam i would suggest keeping the offers very personal. IE:

Hello, My name is First/Last name and I am the owner of www.yourwebsite.com etc, etc.

The bad part is if somebody DOES report it as spam it can effect your email address and your website domain/hosting.

be very carefull - as mentioned, people can (and will) click the spam button on their mail client for almost anything, as if it was a delete button. They don't realize that it triggers abuse reports to the mail providers, etc. They even do it on the confirmation email right after they opt-in to something(!) - so a truely unsolicited email is going to be even more likely to get flagged.

Now if you do this, it is in fact spam.. while that doesn't make it illegal (in the US, under CAN-SPAM - but individual state laws vary), any spam complaints will be justified and could get you shut down by your host.

if you use contact details on an owners website you should be ok
take the trouble of finding the owners name and addressing him/her by
thier name if you want to be taken seriousely.
thank him/her in advance remember website owners receive lots of offers
so carrying out these steps will show you are serious.
