Help with a Paypal dispute...

I was hoping someone from here could help. I have never had an issue with using paypal or getting ripped off until now and I was wondering what the best way is to get my money back. Here is the situation....I recently started a biz doing online advertising for local business in the building trades. I purchased a mailing list to help build my clientele and the list company stiffed me. I paid them by paypal and they were supposed to email my mailing list the next day. They never did and kept coming up with excuses and kept saying "first thing tomorrow" that went on for 5 days. Now they wont respond to me at all. So I put a dispute on the transaction and they responded with a tracking number for a USPS letter and "shipped". I don't know what they "shipped". I have emails and text messages dated 5 days after they said they "shipped" something to me stating "sorry we will email you the list tomorrow". So what ever they said they "shipped" was not my list. Is there a number to call for paypal or is it better to escalate the dispute to a claim online?

    I'm afraid you're pretty much out of luck here.

    What's happened here is that the seller has now shipped you an empty envelope and therefore has a tracking number. For PayPal, this is absolutely sufficient to close the dispute in the seller's favour.

    Now, when you start arguing that what you got in post wasn't what you ordered, you will have to change the dispute type from Item Not Received to Item Significantly Not as Described. And this presents you with another issue - as per PayPal's user agreement, the SNAD dispute type (or any other forms of buyer protection) isn't available in case of dealing with digital goods - meaning that you would lose this dispute as well.

    You can obviously try giving them a ring, escalating the dispute and sending them as much proof as possible - and there's a slight chance you may get lucky and win the dispute, but don't get your hopes up as I've seen tens of cases very similar to this and the turnout is always the same.
