Would you buy a video on Fiverr if it wasn't really yours?

I've noticed a disturbing trend among a few Fiverr video creators.

I bought a video (or thought I did) where the seller made up a song and performed it on camera. Then he posted it to YouTube, which wasn't part of the deal. That made it useless to me, as I had planned on editing it and adding more content. Plus, of course, I want it on my channel, not his.

Now there's another video seller (oldbittygrandma) who insists on superimposing her credits and copyright notice over the beginning and end. Plus she watermarks the video in the middle. Plus she will only post it to her YouTube channel.

These alterations would make it useless to me. Would you buy this?

      I hope this isn't a trend that catches on. I can just imagine having someone record original music and put a plug for their services in the middle of it.

          There needs to be a contract agreement in place for exclusive use or all bets are off.

            Here's what Fiverr says about it:

            Ownership and limitations: unless clearly stated otherwise in the gig description text, when the work is delivered, the buyer is granted all intellectual property rights, including but not limited to, copyrights for the work delivered from the seller and the seller waives any and all moral rights therein. For removal of doubt, in custom created work (such as art work, design work, report generation etc.), the delivered service shall be the exclusive property of buyer. The seller expressly agrees to assign to buyer the copyright in any delivered services that do not meet the requirements of a work-for-hire under the U.S. Copyright Act.             Since there's only 450 characters to play with in the gig description, it would be hard to specify what rights the seller wants to retain. In view of this, the second seller I mentioned above posted a lengthy policy on her blog. But I'm not sure potential buyers will read it.

                Has Fiverr been made aware of these providers?

                If so what was their response?

                • No, I haven't contacted Fiverr yet. I had promised the first seller a nice tip on delivery of the video. Since he didn't deliver it (a link to YouTube doesn't count, in my view), no tip.

                  I didn't hire the second seller but I have profiled one of her gigs on my blog. She's quite funny and has a flair for the dramatic. Splashing copyrights all over the schtick tends to kill the effect, though.

                  I thought it might be useful to bring up this scenario in a forum where many people buy Fiverr gigs, to get their take on it, perhaps formulate a consensus, then talk to Fiverr.

    The should have listed terms and conditions in their offer. Sounds like they are too thirsty for more work, when they should be focusing on providing good work and let word of mouth work for them.

    Well it depends.

    If I wanna send my friend a happy birthday video then I might buy it but if I plan on using it myself then not at all.

    If it isn't mine and I can't use it then it's just a waste of five bucks and I would be better of spending it at Subway

    You set what you want not the seller.

    If they don't agree with your work project up for bid then definitely don't hire them.

    Was the video on YouTube posted as public? Because it's also possible to post videos which can only be seen by people who know the link. Maybe he just wanted to hand over the deliverable through YouTube for some reason.

    Also, you can use a program like jDownloader to download the highest quality version of the YouTube video in mp4 format which you could edit and upload to your channel. (copy the link to your pc's clipboard and the program will recognize the link, parse it and extract all downloadable formats)

    But to answer your question, I would definitely not buy it if the video is filled with watermarks etc. Not even if the delivery method is via YouTube. But personally, I'm just not into the whole buying videos thing. Atleast if it's supposed to be some personal video. That's only because I like creating my own multimedia productions, though

    I would not buy something from a seller who was going to continue to benefit from the transaction by using the item you commissioned themselves.

    Try sending a note to the seller highlighting the Fiverr policy and explaining that as long as the video is on his channel it is useless to you. Also contact Fiverr to let them know about these sellers.

    I've never had these sort of problems through Fiverr, but something similar happened to me a few years ago. The contractor in question claimed that I communicated poorly by not letting her know that she couldn't use the work I paid for. I had actually outlined how ownership would work and was able to get my money back in that situation but it was still a pain.

    • I'm thinking this discussion could apply to other Fiverr gigs as well. Writing, for example. It seems to be an unwritten code that a freelancer won't reuse the article (or heaven forfend, resell it) elsewhere but might it be better if that's spelled out ahead of time?
