Youtube Embedding Legality Question

Just wondering if anyone has any direct experience with the embedding lagalities of YouTube.

Specifically what does youtube mean when they say in

4. A. "You agree not to distribute in any medium any part of the Service or the Content without YouTube's prior written authorization, unless YouTube makes available the means for such distribution through functionality offered by the Service (such as the Embeddable Player)."

  • You agree not to use the Service for any of the following commercial uses unless you obtain YouTube's prior written approval:

  • the sale of access to the Service;
  • the sale of advertising, sponsorships, or promotions placed on or within the Service or Content; or

I might not be the brightest bulb, but that is not specific enough for me.

I have a video sharing/hosting website. We use longtail video player (JW player) and are thinking about offering users the option to use embedded videos for their uploads.

We have much of our own content, we DO use adsense and we DO offer paid ads + affiliate sales. So where the heck do we fit in YouTube?

I think that the statement in RED is very open to interpretation and is ambiguous. How do we know what YouTube deem to be "sufficient value"?

If someone has some suggestions other than contacting youtube directly (already done that with no response) or has some direct experience and knowledge in this area, this would very much be appreciated.

Ive seen literally hundreds of blogs and sites which virtually have 80% of their content from youtube via the embed feature and they serve adsense with no apparent problems.
