Question about PLR...

I saw this plr wso I want to buy. But I first wnat to be sure about the rights part. I tried posting this question on that wso thread, but the seller doesn't answer.

So, here are my questions (then I'll show you what the wso says are the rights)...

_____________________

I've never done plr before -- I have some questions about my rights when I buy this package.

Which of the following scenarios can I do?...

Let's say a friend of mine has a list he sells stuff to - let's call him Joe.

1) Can I change it so "I" am the author, then sell it to Joe, who then sells COPIES of it to other people.

2) Change it so "Joe" is the author, then sell it to Joe, who then sells copies of it to other people.

3) Change it so "I" am the author, then set it up with Joe, so he sells it, and he gets a %, and I get a % of the income.

I'm pretty sure I can do #3 (that a very basic plr right)

Private Label Rights extends you the right to basically do nearly anything you want with it, within the license. You can take ownership over the content, change the graphics, and basically sell it or package it anyway you want.

The only exceptions might be, you need to leave the originator's link, or they may stipulate that you cannot give it away in some cases. In most all my PLR products, they are an open license to do as you will with it, as long as it is permissible in the licensing agreement.

You can't sell it to Joe and call him the author, according to those rights, because you are not able to pass private label rights onto your customers.

That being said, no one can truly answer that but the person you buy it from. PLR comes with whatever rights the creator grants. There is no set rules abou it.

    Hi Tim,

Based on the rights that you've listed, you can only do #1 and #2.

In scenario #1 you're basically selling Joe the resell rights, but just make sure Joe understands that he cannot make ANY edits to the work.

In scenario #2 you're selling the PLR rights to Joe. The rights document explicitly says that you can't.

Scenario #3 is a simple relationship where you are the product owner and Joe is the affiliate, so yes, that's clear cut that you can do this.

Contrary to what Art says, PLR does NOT give you the right to do anything you want with it. You're limited to the rights specified within the rights document that comes with the product.

Also, yes -- I know what Art said couldn't possibly have been correct -- otherwise there'd be no reason to specify the yes/no list of rights!

      Cheers.

My apologies, I should've mentioned the fact that ultimately the license agreement (*or creator) generally determines the 'permissions'.

I went off my experience with most PLR based products, as generally Private Label Rights are often considered to be one of the highest level of licensed right to rework the content, claim ownership, etc...

In any case, the others caught my error () and 'clarified' that it's best to always review the license agreement or consent the license with the product creator.

Where the question arises that you can "sell" it to Joe? - "Yes" and Joe will (likely) receive a copy of the Master Resale Rights License agreement , or in some cases a license specific to just the basic; Resell Rights or Personal Use Only Rights license.

Generally, when you buy a Private Label Rights preoduct with the above licensing permissions, within the files there will be 1 or 2 additional licenses provided to YOU. It's your responsibility to provide Joe with the proper license when you 'push' the files to him. So, in the case of Joe receiving Master Resale Rights, he will receive a Master Resale License from YOu when you sell him the product. *Same goes for Personal Use, Branding Rights, so on and so forth. There's also Virtual Rights, but I'll leave well enough alone after my first post "tanked" -my bad!

Hi; You can do anything regarding the content, graphics and claiming ownership. But when you sell it, the buyer won't have the PLR wrights as you had. He will had the masters resells rights. He can sell the product without editing or claiming ownership

          Cheers

Tina nailed it -- the ONLY person who can give you a definitive answer is the PLR seller.

Give it some time -- it's been less than 8 hours since you posted your question.

For my money, this rules out 1) or 2), but 3) would still be ok.

Would this biz model be considered unethical?...

    1) Change it so I am the author.

    2) JV with someone -- where they get 1/2 and I get 1/2 (selling it individually to their audience/list).

    3) Then, when sales die down, telling them -- hey look, why don't I just sell you the rights to it, so you can sell it from here on out, and keep 100% of the $$? (which, at that point they will jump on, I'd guess).

So, basically I would be getting the best of both worlds.

    Make sense?

Is that underhanded (because I know all along that is my plan -- basically squeezing the lemon TWICE)?

    Please advise.

    Thanks!

You could probably try that but you will need to be upfront with whoever you JV with about the rights. When you go to hopefully sell it to them, they'll need to be told that they will not be able to edit the product at all.

        Understood.

From the JV's point of view, they will be getting 1/2 of the $$ selling it to their audience/list. Basically "found money" for them.

Then after sales drop off -- they will realize they will still get sales here and there from that point forward. Then they are offered a way to get 100% of the $$ "forever" -- by buying the rights (yes, they cannot alter it) -- for a ONE-TIME fee. Depending on what that fee is, I think that would be very appealing.

The ethical question is when you consider I COULD HAVE offered them those same rights from the very beginning (BEFORE the arrangement was they get 1/2 + I get 1/2).

Good thread. I'm just recognizing the value of PLR now and rights are always a bit sticky. Thanks for asking this question. Helps me a lot!
