Hey all, I just had a killer idea of how I want to create a header for one of my products... Do you think it's safe to use other site's logos in the header? I keep thinking it may not be safe, but at the same time... I can't really see why not? Safe meaning, not cause some sort of legal problem. Whatchathink? |

Jamie, I understand what you are saying .. I think ..lol There is nothing illegal, depends upon what you are doing and how you are doing it ... On the image I removed my clients name but as you see it uses apple ipods actual images. This is legal as long as the website says "All other copyrights belong to their respective owners." James |

Ok... sorry, maybe I didn't explain enough/right... What I want to do is use Facebook's logo and a couple of other ones on a header for my product... I have Photoshop and the necessary skills etc, but is it safe to use the logos on my header? I see these logos all over the internet, whether they be on blogs, communities... all over the place really! HHMM... |

Jamie, Ok that explains it a bit better ... Let's take a look at history. There has been many many products (too many) with Google's and eBay's logo on the products, website, and etc.. Now most of these products was not worth the iPaper they was written on but that is not the point here. Google and eBay both have forced some products out of the market while others they have left alone. So is it worth the try to do so ? I think it is not.. If your product evolves around facebook then mention the name that is fine but to use their very own TM name on your product to profit from is very risky. You are better off to just mention the name, create your own text for it and etc.. James |

So, your asking if stealing is ok? You can not steal someone else's images or trademarked material without their permission. (If you have their permission it isn't stealing). I am pretty sure Facebook can afford top notch attorneys to deal with those that try. |

Ok... I see what you guys are saying... I guess I will have to take a different approach. The product does not revolve around Facebook, it is actually my PHP guide that I wanted to portray you can run powerful and interactive sites, like Facebook, like Youtube etc. I will try to things up something new/different! Logos are automatically copyrighted and in many cases trademarked. It is illegal for you to use them. You could get slapped severely.

I would never use someone else's logo, especially if they are a huge company. Chances are they would never find out but it isn't worth the risk. This is just my opinion. The best advice I could give you is not seek out legal advice on a internet marketing forum. You will get all kinds of answers and none of them will be from a lawyer. Well, unless you get lucky.

I don't think it is legal, as other people's images are other people's intellectual property. You could ask for permission, however, and see what they say.

Ethics aside: If you use a logo like that, the more your site become popular, the more there are chances that someone jealous of you will report it. So, one fine day, you may find your income producing site being taken down all of a sudden, all because of one small logo. A logo will not cost that much to design, Or if you cannot afford it, find a PLR package with enough graphic headers. There are plenty of them available. You can profit without doing anything illegal. |
