Can I Use Word "Blogger" As Part Of My Product Name?

Hey Guy,

Quick question: can I use the word "Blogger" as part of my product names?

Now, I'm not using it as in "a blogger" (one who blogs), but rather as "Blogger" of Blogger.com.

I created a product that deals with using Blogger blogs. Can I use it as long as I clearly state that I am not affiliated with Blogger.com?

How about a domain name?

Any advice would be great.

KateD

P.S. I know the best answer is to refer to a copyright attorney. I'm just getting some feedback from marketers.

I would assume Google (who owns blogger.com) won't mind, just look at all the IM products that use google in the name of their domain and products like google manipulator, google cash

(a classic) google snatch (a bit risque:-) LOL, among lots of others, they're making tons of dough doing it and google is getting extra exposure as tons of affiliates descend to promote the products as they are launched. So using blogger in your product name, shouldn't be a problem.

I'd be very careful. Blogger is their trademark, and if you're trying to piggyback off their trademark to sell your product, you may get in trouble.

While it's true that a lot of people use trademarked names in the names of their products, that doesn't necessarily mean that it's okay to do so.

      And, it probably isn't.

      But, I'm not a lawyer.

Dan's content is irregularly read by handfuls of people. Join the elite few by reading his blog: dcrBlogs.com, following him on Twitter: dcrTweets.com or reading his fiction: dcrWrites.com but NOT by Clicking Here!

Dan also writes content for hire, but you can't afford him anyway.

Google recently took someone to court in Switzerland. The court said: "the registration or use of the domain name at issue constitutes a clear infringement of the Claimant's (Google's) rights".

However, the domain name in question was blogger.ch - clearly pushing their luck.

    It wasn't bloggerlessons.com, betterblogger.com or whatever.

I doubt that Google could come after you for such a domain name because there's no capital letter expressing a particular product (Blogger) and blogger is a descriptive generic.

The name is used extensively in products titles, as is Google's own name. Is everyone using it being sued? Of course not.

Nor could they come after you for selling a product on how to use their service, no more than Ford can come after you if you produce a course on how to tune their cars.

    Thanks for the feedback, guys.

I can see that they would have a problem if I were implying that I was associated with them, or if my product took away from their business.

But its the opposite. It just shows people how to better use Blogger.

So I think I'm ok. I'll do a little more research, of course.
