Hey, trying to start an adult niche blog and I want to know issues that could arise from linking to copyrighted videos that are hosted on rapidshare or the like?

Alternatively:
What if the site is a forum so the links would be posted by anonymous "users."

    Well if you want constructive criticism, This might be possible as I know you can do this through YouTube.

    As long as you use the embedding feature from YouTube it is completely fine to do. You are not liable for any copyright issues and you are not liable for any content shown in the video. The account holder at YouTube is liable for what they post in their account. People that embed to their site don't hold any accountabilities whatsoever.

    You will have to check the rules at any video network you use but don't simply download a video and publish it on your site, this would raise red flags for sure.

    It's a good way of making money especially if you monetize properly and can drive traffic.

    It isn't without its risks though.
    Often times you'll also find your PPC or CPC account has been shut down.

    There's a couple issues though:
    1) Where are you hosting?
    Anywhere in N. America and they get a certain amount of DMCA requests and down goes your websites.
    For warez and porn type stuff you'll most definitely need offshore.
    More expensive.

    2) Where are you driving traffic from?
    As far as niches go, warez are kind of saturated at the moment.
    How will you differentiate from a forum like PlanetSuzy or Porn-BB (not that I have a massive porn collection - you can also get your links from there).

    pasting copy written content is not a big issue if you give cresit with every post but in my opinion the problem is the adsense terms of services. It does not allow to publish adds on adult niche site.

      I was under the impression that providing links on your website to content hosted on other websites (eg. tv shows on megvideo, etc) wasn't necessarily an infringement; because the content isn't on your server. What's the difference with search engines who give links to a searcher typing in those search terms (tv show name)? If search engines are exempt, then can I build a search engine or a website with just a search bar that only spits out tv shows based on the searcher's search term? Will that be ok? Quite tricky.

        I wouldn't do it. ICE is very determined to clean up the Internet in so far as sharing TV shows and movies. It's just not worth the risk. Google gets away with it for whatever reason, but you are not Google and don't have their legal dept behind you.

          Quite right. Not worth it. Although it does seem like in the case of Brian McCarthy, the live sports broadcast was what triggered or precipitated the seizure of his website and subsequent arrest. Live sports broadcast is a no-no per my understanding.

        The difference is their pockets are *much* deeper than yours, and they can survive multimillion dollar lawsuits. I'm going out on a limb here to suggest that you can't.

    That was idea at the very start. There are lots of niches that can bring you money. Do not settle on adult stuffs though it's very lucrative. Surviving in that niche is quite challenging.

    Yeah, VERY bad idea. Besides it will NOT make you any decent money. What, Black Label Ads at 1 cent a click or pennies from Orion downloads?? Not worth it...

    Better off starting an adult affiliate site where the vendors supply you with content and all you got to do is promote it. I do it, believe me they supply with plenty to use. And the commission is 50% in most cases.

    * since you are not hosting the content per say, you are still a bridge and lawyers will go after you becasue you are an EASY target.

    Think your main problem will be finding places to link from to get your site up the rankings ... I had a hard time finding adult links when I tried the adult niche one time long ago ...
