FTC Disclaimer on Blogs

Since the FTC is getting tougher on affiliates online, it is important to have an FTC Disclaimer on your blogs.

What generic FTC disclaimer are you guys using on your blogs ?

Here is what I am using on mine :

FTC Disclaimer
Full Disclosure: All product listings are
provided by third party affiliate partners; we
only have limited control over them.
The owner of this site receives financial
compensation if you purchase anything from the
affiliate partners featured on this site.
By using this site you agree to shop at your own
risk.

Any suggestions on what could be improved / added to this, if anything would be appreciated.

Thanks

I use what I call an "Affiliate Disclaimer".

The disclosure that follows is our attempt to fully comply with the FTC's policy that demands we be transparent about any and all affiliate relations we may have on this website. In plain English you, the visitor or customer, should assume that any and all links on this site are affiliate links. If you click on these links and go visit the resulting site, a cookie will be set in your web browser that will cause us to receive a commission "IF" you purchase a product on the other end. This is a legitimate way to monetize and pay for the operation of web sites and we gladly reveal our affiliate relationships to you.

In addition we fully disclose that hyperlinks on this site are in most cases shortened, and in some cases cloaked to hide long ugly links for functionality and tracking purposes. We have nothing to hide and we are proud of our relationship with the fine vendors, products and services found on this site. Link tracking, shortening and cloaking is a very common practice on all types of web sites.

Further, we do not receive physical products or cash directly in exchange for any reviews or posts you find on this site. No one has paid us to do reviews or posts. We have to tell you that it is possible that our reviews and posts are influenced by our affiliate relationships and may create a conflict of interest. We do not believe a conflict of interest exists, but you, the visitor or customer, must decide by considering the affiliate relationships and link techniques we have described. Obviously we would like you to buy the service or products we write about and we are influenced by that fact. We avoid conflict by only reviewing or posting about products and services we trust. We strive to always give our honest opinions, findings, beliefs, or experiences on topics or products we write about and promote.

Other vendors may also pay to place advertising on our sites in the form of banners, widgets, and hyperlinks. These are paid advertisements and while we do our best to only allow quality products and services to be advertised on our site, we are not responsible for claims or testimonials made on paid advertising links.

Seriously, you use wording like what's shown above?!

      Why?

I don't mean it rudely, I promise, but I really wish all my competitors did that ...

I'm being transparent and not trying to hide anything. When someone sees it, they know what it's for. Exactly what the disclosure is for.

That's true of mine, also, but most of them are about 1/20th or 1/10th of the length of yours.

I can see the value of yours if you're perhaps trying to discourage people from reading it! Sorry, perhaps I shouldn't have asked at all: I was just pretty surprised that anyone would present quite so much legalistic detail and verbiage as that when the FTC doesn't actually require most of that at all.

Here's one of mine, for comparison ...

I'm proud to be an affiliate for both the products reviewed above, and that means that if you buy either through a link on this page, I'll earn a commission (without you paying a penny more, of course!), which is money I spend, for example, on hosting and maintaining my websites.

    My disclaimer:

It may come as a shock to you, but I make money from this website. If you purchase something that I recommend, then there is a good chance that I will receive a commission on that purchase. Be assured that I do not suggest products that I do not believe would be helpful to those that are reading this blog. Most of the money generated from this website will be used to buy expensive toys for my daughter, food for my growing stomach, and dog bones for BoBo and Izzy. If you want to buy a product that I suggest, but do not want the commission to go to my daughter’s toy collection, then Google the product and buy from somebody else… but keep in mind that it is likely that the commissions earned by the other guys will most likely be used to fund their plot for world domination and could result in nuclear war.

None of the information on this site is intended to make you think that you can make money instantly. I preach about what I know and make every attempt to relay good information that will enhance your chances of making money online. With that said, I am not your mother. I cannot make make you do the necessary work to build a successful business. I also do not know anything about your intellect. You might be just plain stupid. If that is the case, then you will probably not succeed. Most stupid people do not realize that they are stupid, so please ask a friend for their opinion. Often times stupid people stick together, so be sure and get a second opinion from somebody that you barely know.

Ok here is the disclaimer for the disclaimer The below information does not (nor is it intended to in any way) constitute legal advice or legal opinion. It not a substitute for legal or other professional advice. Always seek the counsel of a qualified expert in matters like this.

I am using the below on all my sites powered by the "bottom-of-every-post" free plugin (you have to manually enter it in the plugin editor but it was easy enough -- make sure that the disclosure statement is attached to any emailed or reader feed of the subject post). This way if we ever have to change it as per new FTC guidelines then it will be a one stop update in the admin console as opposed to making all your pages/posts one-by-one in compliance:

*Disclosure of Material Connection*: Some of the links in the post above are “affiliate links.” This means that if you click on the link and purchase the product or service, we will receive an affiliate commission. Notwithstanding the aforesaid, we only recommend products or services which we use, or have substantively researched and believe they will add value to our readership. This affiliate connection disclosure is made in full accordance with the Federal Trade Commission’s rules and regulations, including, but in no way limited to, 16 CFR, Part 255<hyperlink to the FTC's actual site with regs>. Read our full disclosure and material connection statement <hyperlink to footer Disclaimer button>

I keep it the same font and style as the post above it. Making it look small or obscure, as have seen in other sites, just looks strange - plus could make the reader think you are trying to hide something (and would run afoul of FTC regs in that the notice should be *conspicuous* and *presented in context* with the review/supported/etc product or service, e.g., not tucked at the far footer of your actual blog or white colored text with a white backdrop.). Keep it clear, and contiguous with the subject posting.

The Disclaimer then has the usual boilerplate together the following headings so as to reasonably cover as many bases as is needed/foreseeable in the affiliate sphere so that you don't have to keep changing your FTC Disclaimer ad hoc with each project: MATERIAL CONNECTION [like one above], ALL RECOMMENDATIONS MADE IN GOOD FAITH [any rec's are based on good faith belief value to buyer], READER REQUIRED RESEARCH & DUE DILIGENCE [reader must do their own due diligence and shall not solely rely on this review or material or links contained herein etc].
