Beemp3 Clone - Illegal or Not

Hey guys,

Bit of a legal question, I am quite aware that downloading music is NOT free, but what are the legalities of hosting an mp3 search engine like beemp3? I notice this on this disclaimer:


1. DOES NOT HOST any of the songs displayed on this site.

2. We index these files which are located on remote servers which neither Beemp3.com nor it's affiliates have any connection with / control of / association with.

3. You download MP3 files from another host service. (NOT FROM BEEMP3)

4. All music on is presented only for fact-finding listening.

5. You MUST remove a song from the computer after listening.

6. If You won't delete files from the computer, You'll break the copyrights protection laws.

7. All the rights on the songs are the property of their respective owners.

Just giving the thought to hosting a clone but dont want to get extradited to the US to stand court

    Hi breezynetworks,

    I don't want to sound unhelpful, but if you want to avoid extradition or other legal problems in an area as contentious and currently volatile as this, then asking on a forum for advice is not going to solve your problem in any way, in fact it could exacerbate them.

    If you are keen to do this project and avoid problems, get the right type of professional advice.

      You drive a valid argument but the reason that I am asking is because the answer will help me to choose the correct hosting, etc. I own a movies site and i know the policies regarding direct linking movies (even if they are not hosting on your site) is facilitation of copyright. (I have got a great way to make money off a movie site legally btw, if anyone is interested, just PM me) However, when it comes to hosting a search engine for mp3's, I will not have any "posts" or "pages" with any content that's copyrighted. The result of the search has been initiated by the visitor, just like the results of a Google search has been initiated by the visitor.

      Thoughts?

        I don't know the answer to your specific question.

        The only help I can offer is this -

        I own a movies site and i know the policies regarding direct linking movies
        How did you find out the things you needed to know to make that site compliant? Perhaps go the same route for finding the same things out for this one.

    Thanks for your reply.

    Point well taken, I intend to do so if hosting a beemp3 type clone will not get me into legal trouble However, if it wont get me into trouble, I would prefer to host a site that will assist my visitors to actually find the mp3 they are looking for, not just a link to itunes for .e.g
