Want to create online store

Hi Warriors,

Few days back, I had told that I want to create an article directory and asked your views. I really appreciate your valuable time and efforts.

After listening you all I have decided to not to go for an article directory as you are doing IM for a long time and your advices are really important which cannot be avoided.

Now, I have decided to open a store like Amazon. I want your suggestions on this at below point. But I am very much worry about the legal operations always. I am really not aware of what all these should be taken care of before starting such thing.

1. I want to offer everything on my site like Amazon.
2. Has Amazon copyright of his contents and product images?
3. Do I need to take permission from Amazon and product company to start such a site?
4. Can I copy product images from Amazon or any other site?

Looking forward to hear your valuable thoughts.

thanks
Joseph

    Hi Joseph,

Good news, you can do this without actually having to sell anything (which opens up a whole bunch of other issues).

If you are doing an Amazon like store, then I suggest you become an Amazon affiliate and use their datafeeds to populate your site. Of course, you will want to add your own personal touch, content and marketing strategies to give people a reason to use your site instead of just going to Amazon.

    2. Yes, Amazon has copyrights. Don't copy any site. If you are an affiliate, you can promote their products using their product images. (be sure to read the affiliate terms of use)

    3. Become an affiliate and follow their guidelines

    4. You can't copy images from any site, you can use images with permission.

If you are an amazon affiliate you can get a link called an 'astore' You just add all the categories you want to sell to your astore. Then load that onto one of your webpages. The store is there - automatically! All courtesy of Amazon - so no need to update or worry.

      Hey guys,

Thanks for your valuable comments. Yeah.......its a good idea to become an Amazon affiliate and earn nicely without doing any hard work but I don't want to become an Amazon affiliate.

      BUT

I want to make my own store like Amazon. I want people to purchase anything direct from my store/site and not from Amazon. I have seen many sites which are selling products like Amazon with good quality of images/contents.

      So, my question is.............

      1. What are the legal obligations before starting my own such
      store/site?
      2. What are the legal/illegal things which I must keep in mind to sell
      products on my own site/store?
      3. Is there any act/law/guidelines for designing such site/store?
      4. Do I need to ask something from Amazon or product company?

      For example:
If I want to sell Samsung LED TV then do I need to ask Samsung first to copy images/contents from their authentic website?

I can re-write the contents but not technical details involved with the product.

I hope you must have understood my concern.

Really eager to listen your thoughts now.

      Thanks,
      Joseph

Creating an online store is very easy you can even start for free with Wordpress platform or Prestashop but the main problem on creating store is the product source or suppliers. There's a lot of dropshipping companies out there but they're pricing isn't competitive. Suppliers usually provides images of the products.

Well, you cannot use Amazon's images and descriptions to start your own store. You will have to ask permission to use other people's as well. Site contents are generally copyrighted material.

There's only one or two lawyers here who could give you real legal advice. Perhaps you should speak with one in your location.

As to legal stuff, usually suppliers requires you to submit your company details, contact info, marketing strategies sometimes a bond before they can let you sell their products.

          Hi Joseph,

Ok, as someone who's had an online store somewhat but not exactly like what you're talking about since 1998 I'll toss my my two cents in here. And trust me, you're not going to want to here this.

Based on the questions you've asked it appears you have huge misconceptions about how the retail universe works online. Because every one of your questions gives insight as to how your mind is thinking at this stage of the game and I can tell you those questions are irrelevent to what you need to know.

Let me ask you this..."How much money have you raised to start this venture off, and how many people have you rounded up to create a solid team?

Because you're going to need a lot of both of those to do what you're talking about.

If you are really serious about the type of business you have described, you should be seeking advise here. You need a good legal counsel and a business advisor.

Are you planning to carry inventor and manage the shipping? How many employees do you plan to hire? Where is your financing coming from?

Unless you are planning to jump into this in a BIG way, you might want to take another look at becoming an affiliate of Amazon.

Well, I am quite serious with this business but lacking of legal information.
No, I am not planning the shipment. I want to hire at least 10 people to start the project. Team would be good graphic designer, SEO worker. Finance is not a big issue if I get approvals from all companies.

Definitely, you need to build up a technically strong team comprising of experienced developer, graphic designer holding great portfolios of their previous work, if you are really serious enough to build the online store.

And then read it some more.

Don't stop re-reading it until you realize that you're in way over your head before you've even jumped in the water.

By the way, Amazon was unprofitable for its first 6 years.

Wouldn't you get product info and images from your suppliers? That's what other stores do.

If you want a good shopping cart solution try Bigcommerce.

      Hi Andrew,

I am collecting the approvals from suppliers but most of them are not providing the approval as I am not a retailer and never purchased things in bulk from them.

      Any suggestions about this?
