Filing a DMCA about a Facebook page

There's a Facebook page infringing on my copyright:

Best of Fiverr | Facebook

The twit stole content as well as the name. It is the content I'm concerned with right now.

Facebook provides a means of filing a DMCA, so I filled it out and submitted it. Then they came back and said they had no idea what URL I was referring to. (Um, it's the one up there^, the one I put in the complaint.) Nor did they know which content infringed. (Um, that would be the status update I quoted verbatim, just like I said in the complaint.)

I pointed this out to them and they responded with yet another request for the URL and the infringing content. Here's my question: Do status updates have URLs of their own? Maybe that's what they're asking for? I'd love to send them a screenshot of the stolen content but it's a text form.

Anyone have experience getting Facebook to take down stolen content?

Here is what I would suggest. Send the DMCA notice by mail addressed to Facebook ATT chief legal counsel. Attach a cover letter stating that you previously submitted this on line and you are getting the run around . Explain this letter is a courtesy to them as you already submitted and will they please expedite action so you don't have to file suit. Also suggest they fire or retrain the person who handled your original request.

Have you filed a Trademark on "Best of Fiverr"? If not, I think you're out of luck in terms of the facebook page name. I am guessing you haven't since you're utilizing the Fiverr TM yourself, which I am assuming you do not own.

That is super frustrating with regards to the poor support on the DMCA filing you put in with Facebook.

That's why I'm only complaining about the content. I can't trademark "Best of Fiverr." And of course you're right: I don't own the Fiverr trademark, though I do have permission to use it on my blog.

I've been ripped off a number of times. Usually the perps discover that I'm making it look easy and there's a lot more work required than they thought.

Forget Facebook's online DMCA form. Get their DMCA registered agent's contact info at the US Copyright Office (copyright.gov) and mail your complaint with a print out of the offending content (make sure the url is on the printout).

Include that you're registering your content (which you should do) and you will take legal action if it is not removed.

To answer a question you posted in your original post, Facebook status updates do have their own URL. The date/time stamp beneath the status is clickable, and the link is the direct URL to that specific status.

DMCA notices are for COPYRIGHTED MATERIAL.

You need to copyright it first.

No she doesn't. Anything you create that is copyrightable is automatically copyrighted with no formal filing at all. Filing an official copyright just makes it easier for you to defend.

Pace, the content is automatically copyrighted as soon as it is created.

Registration, which is what you are referring to, is not necessary to have a copyright.

Registration is helpful, and has legal benefits, for filing a lawsuit.

I am sorry for the situation but I am n't really sure if you can do something about it.

I had a similar issue a while ago, I saw a page has my website name, graphics, and URL.

I submitted Facebook DMCA request through facebook and took less than 24 hours to get the page down. As I could prove that the URL, and graphics, and website name is mine.

I am not sure if Facebook can help you because the word FIVERR itself is a trademarked to fiverr.

If you having a DBA for Best Of Fiverr or if it is your company name I am sure you can get this page down.

My advice is contact facebook with DMCA again provide your website URL and Name. also provide their facebook page and explain in the description of DMCA, that you have been using this name for a while now and your blog visitors think that the facebook owned by you.

I think with these circumstances they can retrieve the page. Good luck
