Fiverr TOS: Do you lose the rights to EBooks sold on there??

I was looking at the Fiverr TOS and it says unless specifically stated, that works delivered relinquish all copyrights and moral rights to the customer.

Does this mean that any ebooks I transfer to others on Fiverr lose the copyright I hold on them? Is there a way around this (such as posting ACCESS to a streamable ebook such as on Scribd)??

Ownership and limitations: unless clearly stated otherwise in the gig description text, when the work is delivered, the buyer is granted all intellectual property rights, including but not limited to, copyrights for the work delivered from the seller and the seller waives any and all moral rights therein. For removal of doubt, in custom created work (such as art work, design work, report generation etc.), the delivered service shall be the exclusive property of buyer. The seller expressly agrees to assign to buyer the copyright in any delivered services that do not meet the requirements of a work-for-hire under the U.S. Copyright Act. Additionally, independent of the U.S. Copyright Act, the seller agrees that unless he indicated otherwise in the gig description, once the order is completed the seller assigns along with it to the buyer, to the fullest extent possible under the law, all of its rights, title and interest, if any, in and to the delivered service and waives any and all moral rights in connection therewith.

It is best you state clearly in your gig description that you are the owner of the copyright and the buyer can only read and use the ebook themselves. They are not allowed to pass or sell the ebook to others.

Thanks everyone I appreciate it very much!

So what is the best method for selling ebooks on Fiverr? I have almost 2 quality ebooks but I need some fast cash and I'm not really looking to find a living on Fiverr but if i was successful I would sell stuff on internet else where.

How do I raise perceived value of ebook on Fiverr? Say its a limited time only black friday all holiday sale and say I will jack up the price to 47 dollars for the rest of forever when time is up???

I suggest before you list your ebooks in Fiverr, go and read every free thing you can find by Tiffany Dow. You'll be getting enough info to help you make a decision.

First, set the gigs to be done in a day. Then have a friend buy a gig, once you complete it, your gig should be marked express. Also explain clearly in your gig how it will benefit people.

However, if you need fast cash, Fiverr is not the way. They hold your earnings for 14 days before releasing them. You could try making a WSO with them, instead.

I don't quite follow this part? You can't raise the price on Fiverr. Unless you'd be saying you normally sell it for more in other areas?

The key phrase is in the first sentence:

"...unless clearly stated otherwise in the gig description text"

So, make it clear in the text that you are the owner.

According to Fiverr's TOS, if you sell something on Fiverr (picture, ebook, etc.), the buyer can do whatever they want with it, even sell it, unless you implicitly say otherwise.

Yeah if you state clearly that it's yours then they will not do anything with it.

I guess that doesn't really include copyright on the book, however, better safe than sorry, fiverr is protecting themselves.

I would clearly state that, Buyer Has no rights to distribute, sell or giveaway this product.

I agree. Just state in your gig all of this.

Should be fine. Fiverr just needs to cover their behind.

Thanks everyone for the great info.

I am starting to wonder if this whole internet marketing thing is generally feasible as a business model (for most people) without a very very very significant time or economic investment.

I have two ebooks that are pretty good (one 86 pages single spaced on weight loss for a specific group of people) and the other (almost complete) on how to find a boyfriend. (similar length) I have especially good faith in the last one and the first one is well researched. However, my methods to get traffic or to capture leads seem to not work at all. These big shot dating coaches get hundreds of dollars for 100 pages of great content. The products are good (or i imagine better in the case of the bf book!) than other products. However, it seems all the methods to get traffic (either ones I've tried or others, require an extremely disproportionate amount of effort).

I need fast cash. Should I sell rights to sell the books, since I suck at getting traffic? I even put on FIverr (buy one gig get 8 FREE), which basically included splitting up and selling as large articles (average 10 pages) on specific subjects. It still has no attention.

Should I cut my losses and sell the rights to resell these books? Is that ethical? Is that the fastest way to get money? I am very weary of doing all this work and any little thing I try seems to be relatively ineffective proportion to the effort.

This is for custom created content. In other words stuff you have written as a ghost writer or a video you have made to specific order requirements. I don't think that it would apply to a pre-published book.
