1099 Tax Form: What If they Don't Fill It Out?

hypothetical question:

lets say you paid someone (USA citizen) more than $600 to do work for you and you issue him a tax form 1099 for his work and he refuses to fill it out, can you be held accountable for him not complying?

i had a guy do some seo work and we didn't exactly see eye to eye at the end. i sent him an email this morning telling him i was going to speak with my tax professional but chances were he'd have to fill out a 1099. He hasn't responded back and in all honesty I wouldn't be shocked if he didn't comply.

    Not as long as you sent it and it is correct, can you be liable if you do not send it, yes you can. I learned this the hard way, about 2003, before we really knew the irs starting watching us online.

      still no response from him.

      anyways what if he never emails me back, do i just scan a copy and email it to him then the balls officially out of my court?

      seems like that's what may end up happening.

    The secret is always have them fill out the W9 BEFORE you pay them. I know that's not much help at this point but it's something to remember for next year.
