Need Copyright Infringement Advice

I have a site that has a page, like this. www.mywebsite.com/snap-tool The snap-tool is exactly what the page title is. The whole site, including this page displays current ebay auctions. I have an ebay partner account.

On this page, snap-tools, it displays current ebay auctions for Snap On Tools, and a few other brands.

I got my second email today from Snap On Tools, telling me that this is copyright infringement, and if I do not remove their trademark brand, they will take legal action.

I know most people would say to take it down, but I don't think I am doing anything wrong. If I am wrong, then ebay is wrong to be showing the auctions, and I doubt if that is true.

What's your opinion.

    Well, you might want to talk to a lawyer there.

    My personal opinion (not a lawyer):

    Fugetaboutit. It does not matter whether you are right or not. What matters: is it feasible to push it through?

    I guess that company sits on the longer lever.

    On the other hand: if you are filthy rich and need some pastime: go for it, might be an interesting game for you.

    But if you look at it from a business point of view: I sincerely doubt that your web site (or better that single page) makes the kind of money that you need to push it through.

    But again this is an opinion, not an advice and the opinion was only uttered for entertainment purposes.

      That's a company that operates on a franchise model - and the ebay ads are probably by franchisees. It doesn't matter here what others are doing - you are the target.

      The wording in your post combines copyright/trademark - not the same thing. Did the notices cover both - or is that your own interpretation?

      You'd be wise to google the terms and conditions page for that company and read through it. What you do is up to you - but failure to do anything could be expensive. Legal advice before deciding to keep the page will be cheaper than costs if you lose a battle over it.
