Optin capture allowed this way?

I am selling a product using a paypal service, and that automatically gives me access to the customers e-mail, is it ok to use their e-mail adress for building a list, or do I need them to get to opt-in to a new aweber list?

    They must opt in this is how you know that they actually want to be on your list. I don't think it is allowed but more importantly it is not an effective marketing method.

    The best way to obtain your customer's email for listbuilding is to have them register on your web platform to obtain the product they paid for. This way you'll not be breaking paypal's TOS

      You are completely wrong!

      If you force any buyer to optin before getting the product they have already paid for... you are violating Paypal's TOS.

      To the OP: you are asking 2 different questions as if they were one:

      a) can the buyers' email be added automatically to an Aweber list? - yes it can. There are tools in Aweber for it > go to the MyList > Email Parsers section. Also, some selling/payment platforms have this option built-in.
      Of course, you want them to be on a separate list, e.g. "product-A-list".
      If they were on a 'pre-sell' list before - there are also tools in aweber (Automation) to remove them from the freebie/presell list when being added to the buyers list.

      b) confirmed optin or not. This should be decided on a list by list basis, depending on your needs and what Aweber lets you do.

    Yes. It is still a good idea for this list to be a confirmed opt-in list through a list provider. Most list providers have methods available to automatically opt-in buyers to your list and send the confirmation message immediately. Some even allow you to do single opt-in just as automatically.

    You could just provide them an option to subscribe before accessing your product adding an bonus And a "No thanks" Button at the bottom of the page.
