Does ThemeStore.com have an unfair refund policy?

I visited ThemeStore last week and signed up.

The live previews of the templates looked good, and I was attracted by their money back guarantee, which is advertised on the order page in a little red rosett saying '30 Day Money Back Guarantee'.

I had to check a box to say I bound by their FAQs and Terms of Service. Wanting to double check the money back guarantee terms, I went to the TOS page and was further impressed by the following line:

"Refund Policy

Refunds are available for unsatisfied customers up to 30 days from purchase date."

Anyway, I signed up, paid my fee via PayPal and downloaded my first theme. I am not a web developer, by any stretch of the imagination, and I still found the themes to be beyond by level of understanding - even though they're framed as being super simple.

You know - I don't deny this. I am sure they're very simple for most, but just not for me. Anyway, disatisfied that their themes would be a good investment, I emailed to cancel my subscription and obtain a refund.

I had the following response from them:

The guarantee covers when the customer is dis-satisfied with the themes-- its not the case with you, and you have already downloaded our themes. Also, refunds are only issued via cheque (postage is covered by the customer), we are unable to refund PayPal transactions due to RBI regulations.

Does that seem a little fishy to you? I didn't even pay with PayPal!

None of these conditions were stated either at the sign up page (in the money back guarantee promo graphic) nor were they mentioned in the Terms of Service.

How do you interpret my eligibility?

    First... Nothing anyone here can do about it.

    Second... It's BS. If they pulled that for an offer here, we'd nuke them for it in a heartbeat.

    The Paypal part is probably true, as they're in India.

      Good words. I wasn't looking for a resolution here, just curious if others were thinking the same way as me or if I was reading the situation wrong.

    Their themes look a little complex. Luckily , i signed up with another themes provider. They got an excellent forums that you can ask for advice on how to edit your theme.

    This is BS. It's like offering a satisfaction guarantee on a ebook, then trying to deny a refund because the product was downloaded. How is someone supposed to know if they like the product without seeing it?

    Sounds like it's time for a PayPal dispute.

    Customer can be dis-satified only after installing the theme. With out installing how can the customer be sure of dis-satifaction.

    You can write up him a e-mail explaing your point of view with the emphasis also on the Terms of Services. In case the seller still says the same, there is always the option to file the dispute with detail explaining your point of view alongwith the details you gathered from their Terms of Services.

    You can also additionally write that the Refund Terms was not also clear, as it was no where mentioned that the same will be done using Checks.

    You had not paid via PayPal but the transaction was done using the PayPal as payment processor as you mentioned. But as I seen the Site they are using 2CO as the Payment Processor (2CO aslo use payPal for Transactions), if that the case, the money does not goes to their account (Seller Account) but went to 2CO. Hence the Refund as far I think is Possible with out any issues.

    RBI doesn't says that you can not get Refund. Yes in India Balance is now a days not allowed to be kept in PayPal, infact it is tranfered daily (auto) to the Bank Account Linked with the PayPal, but the Seller can issue the Refund and in that case the Refund will be processed via their Credit Card Liked to the PayPal Account.

    I bought a theme via Paypal that when installed, looked nothing like the demo. It was a huge disappointment. They had a money back guarantee but gave me the same runaround you got when I asked for a refund.

    They refused the refund. I filed a Paypal dispute and escalated it to a claim with screenshots of their refund policy on their front page. I won that one. Felt good.

    I would follow sbucciarel advice. Sounds like a winner to me.

    By the way elegant themes are nice but not that easy to use either.

    It set me back almost a month because one client really wanted a theme from them. The support forum was helpful but they ( ones who were mods ) seemed to give basic info that would fix one thing but open something else up that was wrong so you fixed that then something else went wrong... in the end I had to get a ton of answers to fix one little thing because other things were wrong.

    I believe for installing several themes from them they try to use the same control panel for every theme and some need a custom control panel.
