Subject: Cease and Desist Demand regarding Trademarks and Copyrights‏‏


Body:

It has been brought to our attention that your business has been marketing, selling or otherwise making available products or services that may infringe "Your Business" Ltd's copyrights and trademarks in the product "Your Product" and related merchandise.

We have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law. We assure that the notification is accurate, and under penalty of perjury, that we are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

The product "Your Product" is developed and published by "Your Business" Ltd. All intellectual property rights to "Your Product" are owned by "Your Business" Ltd. "Your Business" Ltd's copyright to "Your Product" and international trademark registrations of the word "Your Product" and international trademark registration with certain proprietary rights. This includes the right to restrict the use of copyrighted works and/or trademarks, or a confusingly similar works or trademarks, in association with confusingly similar products or services.

"Your Business" Ltd's trademark registrations include, but are not limited to the European Union Community Trademark and international trademark registration in several jurisdictions including United States and China.

Your use of "Your Business" Ltd's copyright and/or registered trademarks is likely to confuse consumers and/or lessen the distinctiveness of "Your Business" Ltd's brand. Your continued use of "Your Business" Ltd's copyrights and/or registered trademarks will cause significant and irreparable damage to "Your Business" Ltd.

"Your Business" Ltd demands that you immediately:
1. cease and desist any further use of images, emblems, logos or similar items infringing "Your Business" Ltd's copyrights in association with the manufacture, marketing, sale, distribution, or identification of your products or services; and

2. cease and desist any further use of "Your Business" Ltd's trademarks in association with the manufacture, marketing, sale, distribution, or identification of your products or services.

This is written without any prejudice. "Your Business" Ltd reserves the right to claim damages as well as any other remedy under applicable copyright and trademark legislation, but we hope this issue may be resolved without any further legal actions.

If you are able to find the email to the owner of the sales page who are selling your product without your permission, you should email him or her this email. You will be surprised by how fast they will stop selling your product!

    Only a portion will stop on their own.

    With some, you will need to go to the hosting company to enforce your copyrights.

    But those folks dedicated to a life of crime will be up and running on another domain and another web hosting company the same day.

    The majority of us HATE PIRACY. We don't support piracy at all, but the SOPA and PIPA bills wasn't the right way to stop piracy on. It was bills that gave a "green card" to censore content on the Internet in the Western World.

      All of us? Sounds like you're directing this at everyone here, I have no doubt there will be some bad eggs of course, but you can't tar everyone with the same brush, that's most uncool of you.

      I'm sure I'm not the only one that would find that extremely offensive considering how it's complete bs.

      If you think the average internet user would be unaffected by a bill like this then you really need to re-educate yourself.

      Remember who is behind these laws, people like Lamar Smith who don't understand the internet and inadvertently post copyrighted content on their site without the copyright holders permission ... then end up being the driving force behind a copyright bill.

      Only people that had anything to lose from SOPA was the internet giants like Google, because they'd have to filter damn near all of their search results. The average joe on the internet had nothing to worry about unless they felt their ability to steal from other's threatened.
      Man, you're a persistent troll, I'll give you that. Perhaps you should have read up a bit on the issue before stating such things as fact.

    If you REALLY want to hurt them, inform whomever is taking payments for them (i.e. PayPal). I did this with a popular blackhat WAREZ site that had premium monthly membership option setup with PayPal.

    PayPal froze and eventually banned their account - the whole process took me about 1 hour to submit a copyright infringement, and a few days for PayPal to sort it out.

    Got an email from the owner (who I had already asked to remove my product several times directly but he told me to go #%^@ myself) immediately after his account was frozen begging me to remove the complaint.

    You can imagine my response - we'll my response was in my head - I just ignored him.

    Bye bye to his recurring income stream overnight.

    That is the way to teach these guys a lesson.

    PS: On a funny note, a few months later the same guy emailed me again asking how I managed to get his PayPal account frozen cause he wanted to do it to someone else. Go figure.
