Folks...

Why do you feel that you are owed a {warning|explanation|second chance} whenever your {Amazon|AdSense|AdWords|ClickBank|CJ} account is banned for TOS violations?

These companies are responsible for protecting their customers (read merchants). You are not the customer. They expect you to follow TOS "the first time". Ignorance is not an excuse.

Please, before you get involved in any enterprise that involves another party, make sure you read (and understand) the TOS. If you don't understand something, ask them BEFORE getting started.

These companies want to focus on their "good" partners and do not have the time or inclination to waste resources on someone who cannot abide by the terms that were agreed to when accepted into the program.

    Sometimes the TOS "violation" is not really a violation at all. You get a bad reviewer and you're screwed, even if you didn't do anything wrong.

    I just bought a domain that was deindexed before I had even bought the domain. (It was completely dropped, bought it from GoDaddy normally.) I built a small niche site on it before realizing it was deindexed. Submitted a reinclusion request... it was denied. I sent in another reinclusion request immediately after getting the notification that the first one was denied, just to make sure. I figured if it was denied I'd just cut my losses and transfer the content to a new domain that didn't already have a penalty. Hadn't changed a thing, but it was granted the second reinclusion request.

    Just goes to show that the exact same site can be in violation of TOS in one reviewer's eyes, but not in another's. Which leads to the conclusion that knowing what the actual TOS violation was is important for verification purposes. (It would also help to fix any problems if there actually was a problem. It's not always obvious what the problem is.)

      Yes it does happen occasionally. However, this is the small minority of issues. A large majority of bannings and such are a result of TOS violations.

      You see it all the time in the forums. OP comes along complaining about "unfair" banning. Debate ensues. Thirty posts into the thread, OP provides info that wasn't mentioned in the first post (I was cookie stuffing, clicking my own links, spamming forums, etc).

      When that happens, you are not entitled to anything more than a "you are banned" email.

    I agree that's annoying when people whine about clearly deserved penalties/bannings. I just wish Google would be a bit more transparent as to the "why" in all cases. I'd rather they tell the person "you were cookie stuffing" than not tell the person "your reviewer just got dumped by his girlfriend today".

    I highly doubt that Ebay powersellers who had their long standing, high feedback 99.9% rating account terminated were doing anything wrong.

      They were. Contrary to what the conspiracy theorists think, companies don't just go around banning "for no reason". They just don't.

        But there is no full proof way of knowing if the violation is real. If you had a Google site and I wanted to spam it with clicks, your the one who'd get banned. Would it be your fault? No, but you'd still suffer for it. That is why affiliate programs are screwy.

        I read about a case in California where someone made $500 in their Google Adsense account. Then Google banned and accused the guy of generating false clicks. Then the guy turns around and takes Google to small claims court for the $500. He ended up winning too. The only thing was he couldn't get his account back, but he was entitled to the money he had already made.

          A large majority of cases are legit violations. I do realize that some exceptions do occur but that's not even what I'm really referring to in my post.

          I'm talking mostly about folks who broke TOS and then wonder why they got not warning or no second chance. You don't deserve one.

            Agreed. I just laugh at people who whine about getting banned from Adsense or a similar program, then 5-10 posts later in the thread they admit that they knew they were violating the TOS but didn't think it was a big deal, or didn't think that they would be caught.

    Theres always a grey area of things. This banning spree is usually their algorithm picked something up, or you know your just trying to game the system. Either way, they have all the power irregardless.

    I can speak from experience.. those idiots over at ebay gave me a $36,000K year ban in december for something that ive been selling for over 10 years. 17 contacts, 1 appeal, 3 supervisors, and 5 different reasons why... and still to no avail. We were even told that we were selling stuff that we didnt even sell? Go Figure... so they can go **** themselves.. Now as far as google they banned us for showing our own ads on our own accounts. Go figure? We dont even use google adsense.. so what brainiac.. figured that one out..

    My advice..

    Multiple streams of income...

    Cpa - Amazon - Sell your own products - Plr - Mrr - Flip Sites - ect....

    Just as you would do with your investment portfolio. Diversify.

    Even though ebay gave us a "Spank" because they are a bunch of idiots....
    We still made more that month by

    1) Knowledge...
    2) Diversifying
    3) Not giving up...

    So sometimes it is ok to whine.. when the customer service sucks, has no clue what they are doing, and you know more then their technical staff does.

    I will say one thing... "Things always happen for a reason"
    Just thought you'd like to know XXXXXXXXXXXX sent you $2,500.00 USD

    I agree with you, nice post! Sometimes due to excitement and laziness we tend to forget the importance of TOS. The thought is sometimes, the less we read the more we complain. So I guess, the best way to get rid of violation and no.no.no moments is to read the TOS.
