Those figures are minimum amounts, to conform to some legal rules.
Actual damages are to be determined by the court - and will probably be way more than they've made from the exercise.

I doubt it....they will be settled out of court by a San Francisco Superior Court mediator.

It will be for a fraction of those costs listed IF they agree to stop selling their "tools"

Well, there are hundreds and hundreds of tools out there...most people that were using TA will just move to whomever is still standing

The lawsuit asks for an injunction against the use of those tools and you can bet your bottom dollar the companies who created those tools will be asked to show their books during the discovery phase of the trial.

No doubt one of the reason the lawsuit is being sought against the providers is to discover if broader legal action needs to be taken against the users of such tools.

Look on page 18 of the document specifically where it says "all persons or entities acting in concert with them"...if you're using those tools and violating Twitters TOS that means you, sparky.

The fat lady hasn't even begun to warm up yet.

I don't think so.
IMHO Twitter will nail these people to the wall as an example that if you try to game Twitter, you'll be financially ruined.

Anyway - we'll see who is right as this develops :-)

I went through the exact thing with a billion dollar gaming company 7 years ago almost identical circumstances.....trust me.....they want to settle outside of court. This won't get past the mediator.

I'm not surprised... people hate spam regardless if it's email, fax, postal mail, tweets or blog comments. But this does establish precedent that marketers are financially responsible for perceived damages due to spam...

There's one good reason for Twitter to pursue this, rather than settling for a mediator's decision - precedent.

If they get the jury trial they're demanding, and they can nail some hides to the wall, they smooth the path to stopping more spammers in the future. If they can get a judgment for ruinous damages into the public record, it will make serving notice on the small-timers and bottom feeders easier.

Look at what some fairly well-publicized cases have done for the name "Getty Images" in the world of IP infringement.

As a side effect, if Twitter wins its case then other companies (Facebook, Youtube, et.al.) will have another arrow in their quiver when going after the spammers of their platforms.
