Paypal Dispute Question

Hi Everyone,

It appears that I will have to dispute a charge for a couple websites I ordered from a warrior who has vanished with my money. I'm well within the 45 day dispute window with Paypal, so I could go that route. I think, however, that Paypal will take a "hands-off" stance, since I'm disputing a digital product.

All of my Paypal purchases are charged to my American Express card, and I think Amex would be more sympathetic. I'm uncertain how to proceed. Do I raise the dispute with Amex, Paypal or both? Does anyone have any experience with this type of situation?

I'll appreciate any advice you have to offer.

    Hi John

    If you have tried contacting the seller and gave them at least 5 or so days to reply (it could be a family emergency) etc...

    Just open a chargeback with american express, paypal won't mess with them and your get your money back.

    But make sure you have gave the seller enough time to reply

    Start by reporting the warrior here. Then open a dispute with Paypal. Web design doesn't necessarily fall under digital products. It's a service first. You have a decent chance PayPal will help you. If that goes nowhere you always have the chargeback with Amex option.

        I'm not talking about calling him out. I talking about a services not delivered complaint. The OP says he "ordered" services so I assume he has a thread offering them.

          Gotcha ya. Just wanted to make that clear for him, cause many people don't know THAT rule.

          And we all know some people "offer" services privately...

          I talking about a services not delivered complaint.
          That thread would be deleted - it's not a forum problem unless the purchase was through a WF ad. If that's the case, the complaint should go in the thread of that ad.

          I do not agree with filing a chargeback before filing a dispute with paypal. Let paypal know there's a problem and see if they will solve it. They don't guarantee digital goods so sometimes/yes and sometimes/no. If that doesn't work - THEN file a chargeback.

    I may be wrong but you may find that if you paid with Amex, (using a credit card through the PayPal system without having a PayPal account), PayPal wouldn't handle the dispute, they'd refer you back to your card issuer. Amex will almost always side with the card holder, so you'd have no problem getting your money refunded through them.

      I believe he is right. If it didn't come out of your Paypal balance then I would contact Amex instead.

    Next time get your websites from freelancer websites (vworker, elance, odesk), where you can't lose your money. There you only have to worry about getting original work or not...and you don't release the money untill you are sure of that.

      I want to thank everyone who has weighed in thus far. I do have a Paypal account, but I remove any funds I receive immediately and always pay with my Amex. I don't know if that would change anyone's opinion.

      If I'm understanding the procedure correctly, Paypal has a 20 day seller/buyer discussion period before they'll escalate the dispute. At that point, my Amex bill will have already come due and been paid. If I dispute the charge directly with Amex, they'll place the charge "in suspense" and I won't be liable unless and until they deny the chargeback.
