Do we have to use our name within an Amazon affiliate disclaimer?

Hi guys....

Please take a look at this:

The 10th clause says:

[Insert your name] is a participant in the Amazon Services LLC Associates Program, an affiliate advertising program designed to provide a means for sites to earn advertising fees by advertising and linking to [insert the applicable site name (amazon.com, endless.com, smallparts.com or myhabit.com)].
So in the part that says "Insert your name", do we really have to put our name?

Can we say things like these?

- "The owner of the website is a participant........"
- "www.mywebsite.com is a participant.........."

    Good question. I've used the site name on most of my sites, because that's what the visitors will recognise. They don't know who the heck Kevin is.

    On all of my disclaimers I only put the websites name and my business's name NEVER my personal name

      I actually usually put my real name. But I guess the website name works just as well.

      As a matter of interest, why do you think putting your real name is such a bad idea? I know you need to be careful with personal information on the net ... but a quick whois search will get my name for most websites.

    I don't think so.

    I use a variety of pen-names (including on the site I originally showed them to become approved as an affiliate) and they didn't seem to mind at all.

      Because Amazon will almost certainly say "yes, you have to use your full legal name there."

      Most people don't ask questions like this to get the right answer, but to get the answer they want from someone else they can blame for it later.

      That way, instead of saying "Can I do this?" and being told "no" by someone who actually has some authority on the matter, they say "Can I do this?" and get told "no" by a dozen people but then someone says "yes." They ignore all the "no" answers, pretend the "yes" answer actually means something, and then when someone from Amazon starts making a grouchy face about it they can say "it's not my fault, that guy told me it was okay."

      Questions like this are basically a big flashing sign that says "I don't like or want to take responsibility for my own actions or be held accountable for them."

      I recently opened a support request with Amazon to ask them to clarify some language in THEIR affiliate agreement and they told me to consult an attorney.

      So, good luck with that.

      I have always just used pen names. The intent is that you must clearly state in the disclaimer that you will earn a commission as a result of a sale, which is also an FTC requirement for all US affiliates.
