[CLOSED]Banned Amazon affiliate states?

You can find out the states on the Amazon Associates Program Operating Agreement. It is listed as the last paragraph in section 2.

It states: In addition, if at any time following your enrollment in the Program you become a resident of Arkansas, Colorado, Illinois, North Carolina, Rhode Island, or Connecticut, you will become ineligible to participate in the Program, and this Operating Agreement will automatically terminate, on the date you establish residency in that state. In addition, you must promptly notify us in writing of your Arkansas, Colorado, Illinois, North Carolina, Rhode Island, or Connecticut residency.

Cali is okay now! I just got my first deposit from them. The messed up Cali internet sales tax law was to blame in our case, Amazon was just strict to enforce it.

Illinois is no longer banned. Our state supreme court overturned the "Amazon law." I finally have my Associate account back!

Really? This is awesome news. A few days back I was just thinking about how I was saddened by the idea of not being able to have a Amazon associates account. Thanks for sharing.

Yes, California was reinstated when the bill to tax goods sold in the Internet failed. Can't recall if Governor Brown did not sign it or if it failed in the legislature. This is a good reason not to make Amazon a main source of income. Many folks lost a good chunk of their businesses through this. I think the only alternative is to incorporate your business in a different State, but I am not sure of the legalities of that.

This blog post by the Performance Marketing Association (PMA) lists the states. It includes Georgia but it actually goes into effect (the nexus part of the "tax reform bill" the state passed) in October, not July, if I'm not mistaken.

Also, a judge in Illinois ruled that state's law unconstitutional in a suit brought by the PMA.

Sounds to be that the Amazon affiliates should have come together
for a class action lawsuit...Its sounds like very retard behavior for
a company to ban states/affiliates because they dislike a tax/law, so in
return they punish the affiliates/states? The very same affiliates that make them $$$. What will amazon say next? we are going to dump our entire
affiliate network because we do not need them anymore; I guess
they could do that, but expect massive amazon layoffs if it happened...
If they ban the entire affiliate network massive profit loses, etc....

If amazon takes away my $10/mo site then no harm, no foul, move on,
if they take away my $10k/mo account because they act foolish, and take
away my living for some non-legit reason, then I see litigation....

If you are doing the right thing, then you should never be scared
of having to loose your income from amazon just because they
want to hold affiliates/states hostages in order to get their way....

In my personal opinion, it sounded like it was amazon's way to dump
highly paid earners, then move on, then start over again later....

and why shouldn't amazon get sued for pulling such a stunt?

Just curious, does anyone know or has anyone tried to get set up as an affiliate with Amazon who lives in one of the banned states using a relative's or friend's address in an approved state?

Ah, yes. :rolleyes:

My mother in law lives in another state.

All I did was change my address to her state when I received the notice from Amazon (like 3-4 years ago). I'm still using the same bank account in my state.

So, when she receives my W-2 form Amazon, she mails it to me.

I have never had any issues or questions from Amazon. And, last year was pretty good for my Amazon income (not that it is huge, but respectable).

But, beware, play at your own risk.

So Amazon had no problem with the fact that your bank account was in the banned state? What about state taxes, don't you need to file in the state where your mother in law lives?

Is your Affiliate account separate from the account you purchase with?

Yes, I did that. I live in California, and my brother in Montana agreed to be my "Affiliate Programs Manager." We set up the account in his name. He got the payments, and he was sent the earnings. I paid him a percentage for his troubles, and because he was going to pay the taxes. He sent me the balance.

Montana got their state tax revenue. The IRS got their fair share. Only California lost in the deal.

Another California friend just made their college son in another state the owner of their Amazon account, so he got the money they were probably going to be sending him anyway for college living.

Large corporations do this all the time! Doing things like shifting their "headquarters" to Ireland or someplace else with a tax advantage. No reason us little guys can't do it, too.

I live in colorado, a banned state. Instead I use ebay partner network to promote physical products. It's not bad. I do miss Amazon though.

Amazon has opened the affiliate program to residents of Illinois again, since the state supreme court ruled the internet sales tax unconstitutional in October of last year.

If your business mailing address is in another state you are fine. I use a mail forwarding service to have a "good" mailing address. As a sole proprieter you would not have to incorporate in another state per se as long as you do not have a LLC established. Now of course I am no lawyer or amazon specialist or a tax accountant so grain of salt, but I have been doing fine with a mailbox in one state and me in another state.

That list keeps on growing. I wonder, is Washington DC a state? Certainly glad I do not live in a state with a ban, but we do worry. Frankly, we like to do business with amazon. They always pay us. Yeah, this company is a proven winner. However, it seems they add more states to the ban list every year.

According to the current version of the above paragraph, the only states that are still banned are Arkansas and Maine. (Which makes me happy, since I live in Colorado.)
