oDesk Funds Misappropriation Advice Requested

Hopefully someone can help me understand what is happening here and perhaps suggest the best next move...

I hired a writer on oDesk a few weeks ago for a fair sized job and paid, lets just say more than a couple hundred bucks up front.

oDesk holds payments for about a week before they pay the writers. During that one week period, the writer came up with every excuse in the book for not getting the work done (e.g. one sick kid, then another, etc. etc.). After the one week period, the writer said they wouldn't be able to complete the work due to pregnancy related issues and entered a refund.

After about a week of the refund saying "pending" on my account, I contacted oDesk and asked them what was up. They said, hey just be patient, we'll pay you once we collect from the contractor. After a few more days, I contacted them again and this time they said, sorry but we regret to inform you that the contractor already withdrew the money and there is none there for us to refund you - we will try to get it for you from her future work.

So, I contacted the writer, and she said, no way, I didn't withdraw any money, here's a picture of my account, yadda yadda.

I contacted oDesk again, and related what the writer said - and this time they come back with, yes that is correct, she didn't withdraw the money because she had other outstanding refunds. In other words, my money had went to pay other people this person had already scammed. I asked if they realized that this was the definition of a Ponzi Scheme? They did not respond to that question.

Meanwhile, the writer is swearing up and down (via gmail mind you, not on oDesk) that this is all a terrible mistake and that they are trying to get it resolved as well. oDesk has very little to say other than, be patient and let us try to work on this.

So, I'm wondering if any of you have had or heard of a similar experience? Also am wondering what is the best next move? Am very inclined to enter a dispute for the charge on my credit card for starters. Any suggestions as to what is going on here and what to do will be helpful - and hopefully this will all be illuminating to somebody else down the road. IF I ever use oDesk again (big IF right now), will definitely never put more than a few buck up as an upfront payment.

    And what does it have to do with oDesk?

    oDesk holds the money until you clear it for delivery to the supplier. Just let oDesk know that the writer did not perform the task and get your money back.

    Second, that is the challenge you face with hiring writers from a freelance site. Most "writers" are people who thought that they could write for money, but when it came time to deliver, they couldn't do the job.

    Third, freelancers have real lives and real problems too. Maybe the excuses were legit, maybe not.

    And fourth, finding reliable writers is much easier if you take the time to look at signatures here in the forum.



    p.s. Take a moment to go here and learn what Ponzi Schemes actually are and how to identify them.

    Here's a tip...never pay upfront unless and until that person has proven themselves to you in previous projects. I've had lots of projects on Odesk and I always pay 100% upon satisfactory completion of the job. I've never had a problem getting lots of good bidders doing this.

      As a writer myself, I never take a job that's not paid up-front. I've had too many clients in the past try to weasel out of work after I've completed it and that doesn't cut it for me.

        I don't know how oDesk works, but if the writer never delivered the work, then you need to contact oDesk directly and find out what your options are. I would assume you would have to agree to release the funds after approving the work, so I would be very surprised that the writer was just automatically paid after a week without delivering anything.

        As for this being a "Ripoff Ponzi Scheme", you really have no idea what a Ponzi scheme is, as Bill pointed out. The title of this thread is completely inappropriate.

            Yeah, it makes more sense now, but it is still not a Ponzi Scheme.

            I'd advise to give oDesk time to work it out. If they don't, you always have the chargeback route available.

            But if you exercise the chargeback to quickly, you may be blocked from oDesk forever.

            Again, the writer's excuses may be real. Those things happen. My wife got sicker than a dog the last time she was pregnant and was on bed rest for 7 months. We still almost lost the baby at delivery. Emergency C-Section saved his life.

              Right, not technically, however, the fact that my money went to pay back other people she may have scammed and they were going to wait for her to do more work (i.e. scam other people) to get my money, gives it a lot of things in common with a Ponzi scheme.

              I really want to believe the writer, she has quite a presence on the web with writing for well known sites so I really feel conflicted here.

            It does make more sense, however, still not a Ponzi Scheme. However, it does sound like a very unfortunate experience and if that is truly how oDesk is handling it, they don't sound very professional.

            I agree with Bill and JaRyCu - give it a little more time. If it's not resolved in another few days, then either go the chargeback route or the arbitration route - if that is an option. You definitely deserve to get your money back if you never received the completed work.

            As for the writer, she may be telling you the truth - both regarding not withdrawing the funds and her personal situation that prevented her from completing the work. Life happens and it is very frustrating to both parties when unfortunate and unforeseen circumstances delay or interfere with the completion of an important project.

            That being said, I still highly recommend you change the title of this thread - it is still inappropriate. Perhaps something like, "Advice Needed Regarding Problems with ODesk".

              Okay, I agree with giving oDesk some time to work it out and I appreciate that advice. Also I do not find anything the least bit implausible about the writer's excuses - but on the other hand it is all pretty coincidental.

              Okay, I have no problem taking the words Ponzi Scheme out of the thread title - however, I think the fact that they told me my funds got used to pay back other people who got NSF Refunded - and, maybe more importantly, that they seemed ready to leave everything in place for it to continue further (so I could get paid back), should be mentioned loud and clear on here.

                Okay, after taking a chill pill for a few days to let oDesk work on the problem, they came back and said they would be issuing a customer service credit for the full amount.

                They said the writer called and explained that she was nine months along and stressed out so they decided to take on the negative balance themselves and let her work it off when she was able. Not sure a lot of other places would have worked it out that way, so will definitely give oDesk props for taking care of the customer and also for cutting the writer some slack.

                So, many thanks, you guys, for the level headed advice - was a bit more aggravated than the situation warranted at the time. Glad I came here first instead of just calling out the national guard!

    OK I'll post again.

    I've never used oDesk...only vWorker when I was first getting started. When I had a non-compliant employee, I filed a dispute for arbitration and stated my sited of the case. vWorker sent it to the employee and gave them XX amount of days to respond. If the responded, vWorker attempted to create a settlement by getting us to communicate; if not, I won the arbitration and got my money back.

    I'm fairly certain oDesk should have a similar mechanism. Look through the actual job posting where you accepted this person as your employee if see if it does.

    I hired a writer on oDesk recently.Work was OK, but I had told him I wanted an exceptional product. I was willing to pay more if he could do that. The work was ok, but not exceptional, and I told him so. He appologised, and I paid him what we agreed on.

    I just found some exceptional writers here on WF. A bit more expensive, but I am going to pay ghe higher rate because I want good work. You have to pay a decent price if you want a good product or articles. Much of the money I have spent on oDesk and, I forget the name of the other outsource sire I used in the past, has been for sub par products/articles. I am going to stick with the new writers I found here on WF.

    I think that's how Odesk's processes really work. Once the employer pays a contractor in full, Odesk may use that balance to pay the contractor's other employer who's requesting a refund.

    Two points to keep in mind when working in Odesk:
    1. It's best to pay on a per hour basis. As an employer, you'll only pay for the work done.
    2. If you and your contractor have agreed on a fixed-rate type of contract, check out first if that contractor has good reviews (count-wise and score-wise).

    Going out of the Odesk topic, you'll find lots of content writing services here in Warrior Forum. Just like how one of our fellow Warriors said it, you'll just have to make a quick research in here.
