Email From GoDaddy - What is this?

I haven't used any of my domains in a while, they aren't even hosted right now. I saw I got a charge from godaddy for 29$ and also got this email:

We recently received an inquiry related to your domain name, . The specific inquiry related to your domain name can be described as follows:

We have received notification that a legal complaint on the domain name(s) has been filed through the National Arbitration Forum, http://www.adrforum.com. Please contact domaindisputes@godaddy.com with any questions.

In accordance with our registration agreement, https://www.godaddy.com/gdshop/legal_agreements/domain_registration_GD.asp?prog_id=GoDaddy&mgrshop per=cbuhdblgdgabkglhejbdvhocxbjczbmbwbgjfaaihjbeoa tiiabiyfkgojqhnajckjjcjdvdndserdxjkgljmaycafncygya ¤cyType=USD&isc=gdbb135, we have charged your credit card in the amount of $29.00 for our processing of this inquiry.

    Somebody has open a dispute concerning your domain. Could be a trademark claim on your domain. Godaddy will lock you domain to prevent it from being transferred until the resolution is done

    Sounds like you may have registered a trademarked domain. I can think of no other reason for the dispute. Without knowing what the domain name is, that's only a guess.

      Well, I sent them a nice email appologizing and asking if they could give me a refund. Anyone think it will happen? I wasn't contacted over the phone at all about this and I never look at the email that I use for godaddy so weren't they in the wrong for not contacting me by phone?

        No ... they do not have to contact you at all. They can file a dispute or even sue you. Basically, not registering an infringing domain falls in the area of your responsibility.

        You're not likely to get a refund. It would have been nice if the company who filed the dispute had just sent you a cease and desist first to see if you would just hand the domain over to them peacefully, but they did not do that.

        I would personally contact the people who complained and offer the domain for free and apologize and see what happens. Asking for money from them gives them proof of bad faith registration.

    Two issues:

    First, you have been sued due to one of your domain registrations.

    Second, GoDaddy charged you $29 to handle receipt and forwarding of the claim, and to do whatever it is required to do as a domain registrar, such as locking your domain until the dispute is concluded.

    As for the $29 fee, I only briefly skimmed the agreement linked to in your post, and did not see where you agreed to pay GoDaddy $29, or any amount.

    You may want to get further clarification from GoDaddy.

        No to late as the dispute is open and you cannot touch that domain. You are still the legal owner and you can't even delete it anymore. Contact them asap to resolve this before they proceed further.

        Again, you should just contact them and offer to give them the domain. That would probably be the easiest route to go to avoid any attorney's fees, etc. if they should go that route.

      Here's what appears to be the relevant part of the agreement:

      Go Daddy reserves the right to charge you reasonable "administrative fees" or "processing fees" for (i) tasks Go Daddy may perform outside the normal scope of its Services, (ii) additional time and/or costs Go Daddy may incur in providing its Services, and/or (iii) your noncompliance with this Agreement (as determined by Go Daddy in its sole and absolute discretion). Typical scenarios include, but are not limited to, customer service issues that require additional personal time or attention, fees incurred by third-party payment providers such as PayPal, Alipay, and Certegy (as defined in the Universal Terms of Service Agreement), fees incurred as the result of chargebacks or other payment disputes brought by you, your bank, or a Payment Method processor, and disputes that require accounting or legal services. These administrative fees or processing fees will be billed to the Payment Method you have on file with Go Daddy.

    I had a problem with a domain before. Not a trademark but a domain same name with a different tld. I also had to pay the $29 to godaddy and the other domain owners won the case. The domain was handed over by godaddy to them. I disputed the case but didn't have attorneys and a attorney friend help me.

    When they won the case you loose the domain and don't have to pay nothing but the new owners can the sue you for attorneys fees to prepare there case.

    Best is humbly approach them saying you made a mistake and they can have the domain. Don't ask for refund or even the $29 from godaddy as your being a trademark could be more trouble for you. If you parked the domain and earned from it the trademark owner could sue you for loss of income if they win the case.

    Not being neg here but been there once before and the headaches that goes with it is not worth the $40 you are loosing.

    Take it as a lesson and next time you reg a domain and then find out it is related to a trademark just delete it.

    I've blogged about this before. This is one of four "hidden charges" Go Daddy
    tends to "fine" on customers deemed to violate any term of their registration
    agreement or so.

    Someone filed a Uniform Dispute Resolution Policy (UDRP) action against you
    for your domain allegedly infringing that party's trademark. Go Daddy charges
    that $29 thing upon receiving that notice of a filed UDRP action.

    A Go Daddy executive said they'd refund that fee if the domain's owner won.
    If you are considering, say, doing a chargeback or disputing the charge, Go
    Daddy might lock you out of your account and domains. (which, alas, is also
    covered in their legal docs...)

    One can challenge it. Only if one can afford to, maybe.

    Somewhat fortunately, I've yet to know of any other registrar doing this.

      I'm surprised they do this. If GoDaddy has a set fee for UDRP work (which is their contractual obligation as a domain registrar) then it should be disclosed. Not a "we reserve the right" to charge some unknown "administration fee."

      It could be hard to enforce a contract term where the term is never disclosed.

      Maybe it has never been challenged. Next week the fee could be $1290.

        Why should GoDaddy pay for a user's deliberate violation of the ToS out of their own pocket?

        The user is purposely violating trademarks to scam people and you think GoDaddy should cover the costs?

    You could also talk to godaddy via phone in order to get all of your questions answered.

      Do you host sites with Godaddy or just park URL's

      If all you do is have parked url's transfer the rest to namecheap or some other place and then dispute the charge with the cc company
