Using #1 Rated In Logo Slogan Against The Law?

Hey guys I took over a new ecommerce store and am changing things around for conversion. Let's say your business name is Pets Are Us and your slogan is Your #1 Rated Pet Store or something along those lines. Would you say this is unethical even if you offer superior support? Or can it just be considered a tag line for higher conversions no harm no foul type of thing?

Thanks guys probably a dumb question but not positive on what to think about it at the moment.

    Do whatever you gotta do to get the conversions as long as it is legal, split test slogans to see what converts better.

    Its a little in the grey area. Its a broad statement. If you said #1 rated by (some company) then its a little specific and would be considered lying. By saying the statement with no company or name behind it you could technically mean #1 rated by yourself.

    It is perfectly legal. How ethical it is, thats debatable. But lets say you took a "survey" of 5 people and they said that your site was the best, then it is a true statement.

    Using the "#1 Rated Pet Store" is perfectly fine but I am not sure about the "Pets Are Us" name. Do you own the rights to it?

      hahah no that was an example im not even in the pet market but my logo is along those lines in my market.

    Thanks guys I was thinking the same thing. As long as I am not claiming that a leading business didn't rate me #1 thought it was ok but wasn't positive. You all are awesome thanks for the fast response!

    I've actually talked with an attorney about this. It's perfectly fine to claim to be #1 "something generic" but you can't claim #1 "something specific" without proof. So saying #1 dog house shop is just fine, but I wouldn't say something like #1 in dog house sales without some sort of proof.
