At what point do you have a firm conversation with someone you purchased a service or item from when they have not delivered? I purchased something that was supposed to be completed within 3-5 "working days" and I have not yet received it. It has now been 10 days. I keep getting responses from reasonable to nearly unbelievable as why the product is not completed. I wanted to hear from my fellow Warriors what they would do in this case. My main concern is that bringing up this disappointment may turn into a confrontation which will result in a lackluster product being delivered.

I would negotiate a contract with them at the beginning that mentions about late penalty.

I usually pay only 20%, max 30% of the invoice so they are motivated to work. Then I introduce a late penalty for each late delivery date.

This way, the person working will have the motivation to avoid pain introduced by the penalty that I impose and they know that from the very beginning of the deal.

Did you use paypal to send payment? Try reporting them and saying they did not make good on their product/service. If you wait more than 30 or 45 days then there's not much they'll be able to do to help you.

I am generally very firm with my outsourcers from the start and do not accept late delivery it takes a little bit of time but eventually you will have a group of people that are trustworthy and reliable.

And they also know that you won't stand for late delivery

Light a fire by requesting a refund, since they haven't delivered. If they have a WSO or WFH thread, post your review there.

Usually ~1-2 days after the deadline, as I like to be a bit flexible with them.

Depending on the people I trust to do good work or not anyway, I usually pay them after the work (as people said before, it motivates them better).

Have the conversation first, be a bit aggressive - even if you're not really in the position of power anymore (you sent the payment already). If they deliver cool stuff, make it clear that next time you want it on time. If they deliver crap, just post a bad review on their thread (if applicable).

Well, there are measure you can take pre or post a contract/project.
Make sure you escrow your funds
Negotiate your payment process with them
List you bonuses upon quick delivery
List your penalties when there are late delivery

Some great points have been made concerning outsourcing on other sites. This is a product from someone that had a service in the WSO section. To be more clear it was for a niche website. I really want to go about this the right way because I still want my investment to result in a great product and not become a piece of junk because I lit a fire under their bottom. Any further advice would be greatly appreciated.
