Should I buy a domain name that has too many backlinks?

I found a domain name on godaddy's auction that I would purchase in a heartbeat except I checked the backlinks to the domain name and they're really spammy.

If the domain name is tranferred to a new owner will google still penalise the domain due to the existing spammy backlinks?

Good catch, it will cause you problems. Sometimes you can clear the linking but unless it's a great URL name, I'd let it go

Well when the domain changes hands all those backlinks will still be pointed at it, so if they're penalizing it now, they'll penalize it when you transfer it. Personally I'd stay away from it if you plan to do anything SEO wise to promote it and you think the links pointing to it look spammy, you would be setting yourself back and giving yourself another hurdle other than Panda / Penguin, definitely don't want to do that!

You first reaction was to avoid, I say go with your gut!

I think I heard somewhere that now yes, bad incoming backlinks can damage your site's SEO.. which kinda sucks cos it means theoretically, people can take out a competitiors website.
However, I would not let "many" backlinks stop you from getting an otherwise good domain name. I've seen some sites with tens of thousands of backlinks and still having PR5 or higher. In other words, I don't think it's a deal breaker if you like the domain name.

Yeah you're right, negative SEO can potentially be a big problem with malicious users and bad incoming backlinks can damage your rankings for sure.
