Common IM Legal Issues

Hey All,

I'm curious what some of the most common legal issues you guys face in IM? Do you generally hire legal consultants for your issues, or do they mostly involve earnings statements, disclaimers, and privacy policies - things that you can swipe?

    Let me take a quick stab at this...

    Things that I have run into the most are stupid DMCA notices - which is when some idiot contacts your host or even your ISP and tells them that you are infringing their copyrighted material. This really starts to happen when you start making an impact in your market. So, even if you're like me and you take strenuous care NEVER to infringe, you might still get these. If you have a good webhost, they should take your side - but, it's still pretty annoying when it happens. You have to shut down whatever website the complaint was regarding whether you did anything wrong or not. It's shut down fist, prove your innocence later.

    Every GREAT once in a while, I've heard of PLR sellers receiving 'Cease and Desist' letters from lawyers - this also happens from time to time with people who repost content on AdSense sites. Again, if you're like me and you take good care to make sure that you aren't actually doing anything illegal, it should end up being okay, but again, still quite a bother.

    And of course anytime that you go into a project with a partner, you are putting yourself at legal risk. Make sure that you have signed legal agreements with you do a big JV. Seriously, bring this idea up to your partners. If they're serious, they should understand.

    DMCA is definitely a big one.

    Not getting paid from advertisers is another issue.

    Email spam (CAN-SPAM)

    Sales Copy that violates FCC.

      WOW! Do you use the old 7 forbidden words? Do you use prohibited equipment? Otherwise, the FCC shouldn't be a problem.

      I would be more worried about the FTC - they've implemented some new regulations that can really mess up your business model if you're not careful.

    Besides the copyright issues pertaining to the other documents you mentioned, this is one place you do not want to go. One Warrior just tried borrowing an earnings statement and is now an ex-Warrior.

    Wow, useful information guys and I really appreciate it. Sounds like most of your bases are covered until you really start making a splash in your market (and presuming you're not spamming or swiping anything), but that that it's best to be meticulous and cover you bases from the start.
