Death Of Affiliate Marketing

OK...maybe a bit melodramatic, but I've never made a "Death of..." post before and thought I would give it a shot.

Nonetheless, this news story may have many affiliate marketers rethinking their approach:
FT.com / Companies / Media - Advertisers brace for online viral marketing curbs

The FTC may be about to hold YOU liable and sue YOU for making false claims about the products you promote (as well as the vendor).

This would, of course, sling the government-regulation doors wide open on the IM world and I'm certain more and more regulations would quickly follow.

    Simply make sure the products you promote live up to their claims and that your pre-sell info is correct.

    I guess that means more people are going to have to actually purchase a product before they decide to promote it.

    If you haven't actually purchased the product you're promoting you'll have to research it thoroughly by way of reviews etc to make sure it does what it says on the package

      problem is, reviews are quite often written by the creator, or people gaining free access in rtn for a review

    Ok, lets take the example given...the skinn cream curing eczemza. The blogger says it cures eczema. Well maybe it cured his condition...who's to prove otherwise.

    Speak to anyone about anything, and I'll guarantee that there will be different opinions about it. Yeah the Mercedes clk 200 is the best car ever..no its not I drove one and it fell apart....who's right?

    Really though its a disturbing overtone. How can a company stop peoples opinions of their product.

    Blatant stuff like " I made $200,000 last week using this product" are clearly lies, but how do you regulate it. For example how could a company with 1000 affiliates monitor what each and every one of them is doing to promote their product.

    I'm guessing that this is more aimed at the large corporates, but the devil will be in the detail.

    I'm also guessing that more and more companies will then throw the liability back to the promoters of the product.

      Let's hope you also don't ever use a .com/.org/.net/.info domain name, then, which the FTC can seize, regardless of your location, just as they did with all those poker sites last year ... :rolleyes:

      I think they'd probably prosecute you, rather than suing you, for that? But for that, they would actually need physical jurisdiction, perhaps?

    This refers to Paid Reviews such as "Pay Per Post" whereas you get a free sample, write a review and provide a content link to the company's website that is supposed to artificially inflate their Page Rank. This does not refer to affiliate products from what I understand

      You are right that the main focus of this news article is for bloggers that write a positive review in exchange for the product/compensation.

      But I would like to direct your attention to the next-to-last paragraph which states:
      The main target of the new guidelines appears to be the widespread practice of viral marketing in which companies recruit non- employees to talk up products in exchange for samples or promotions.
      The word "non-employess" could be interpreted as affiliates and the phrase "in exchange for samples or promotions" could be interpreted to mean commissions.

      Also, the Financial Times may not have fully understood the story they were reporting.

      Ultimately though, I'm certain that if the FTC will not target affiliate marketers now, then certainly very soon. Once they start down this road, they won't be turning back.

    Marketing a product that sells itself is the key to successful marketing. It is of course not easy to spot such products without some sort of experience in affiliate marketing.
