I have found a blog giving away free WSO's contacted and sent DMCA but nothing!

Hi Warriors

I was browsing around the other day on the internet, and came across some blog I don't really want to post the direct domain here, anyway, the blog offers free WSO's in the way of offering spam offers I believe.

I actually took the trouble of contacting the host/domain registrar, being that one of my old JV WSO's was on the blog, I filled out DMCA's against this blog in the way of it using stolen content. I'm afraid to say that the hosting in hand seems to be some what harboring this blog, I was contacted with an email saying how they had not received any DMCA form.

I explained that I had filled out the form, this has happened 3 times now!! so regardless to me explaining that the form has been filled out and submitted, they reject any traces of these DMCA forms.

Thoughts on this Warriors?

    If you want to prove they got it, send them a certified letter.

    If you are serious, get your lawyer to send them a certified letter. They'll pay attention to the letter head.

      Well they are offering my own created content, that should really be enough for them to sort it out, being that I have provided the exact links to my content, and the perpetrator in hand that is using their services.

    I had a problem with a torrent site hosting (I thought - turned out not to be true) some of my copyrighted stuff and the first couple of emails were ignored. I finally said that I was going to contact the BBB if they didn't respond, along with Google, and let them know what was going on. THEN I got a response.

    I agree that using a lawyer is probably the best way to go, but if you don't want to spend the money you could try what I did and see what happens.

  • Most of the hosting providers, especially offshore hosting providers, reject DMCAs. Is the blog hosted on an offshore host? You could try and send the hosting, or even the blog owner, more letters, but if you are really serious and is willing to spend a hefty amount of money just to stop this illegal activity, I'd agree with the warriors' suggestions above: get a lawyer and send them the letters they deserve.

    Well guys in all honesty the WSO I'm talking about, is not something I bother to sell anymore, however, this guy is posting all the new WSO's on his blog, and is ripping off hundreds of Warriors you see. I will not be spending out thousands on legal lawyers no. Perhaps, if anyone wants me to show them this blog feel free to PM me for it.

    I am just sharing this in case someone wants to take further action, than what I have already done myself, I certainly wont be paying out for expensive lawyers.

    Just goes to show though, how mucked up our rights are these days!

      Sending the notices one at a time makes it easy to say 'we never got it'.

      What has worked for me in the past has been to email the site owner (or domain owner) the DMCA notice, then use a naked CC: to copy in the host, the abuse addresses for the main SE, the abuse address for any monetization sources (both the company making the offer and the network if there is one), YouTube if they post videos, etc.

      The long list of abuse addresses pretty much eliminates the 'we never got it' excuse, and provides a small show of 'shock and awe' compared to a notice without the CC: list.

    First, you have to only send a DMCA for something that is yours, so everyone who is being stolen from would have to send one to get it removed.

    To send the DMCA, it has to have certain information presented in a certain way and issued directly to the hosting abuse department or DMCA department. Who is the host and where are they located? They may have an upstream provider who is more responsive.

    If you are really serious about it, don't send them emails, call them and talk to them, try to get answers from them, explain your case, that might do something. Sending emails won't help. A lot of them will ignore it.

    Secondly, take it as a competition for the future, drive more traffic to your sales page than that rogue page, report the site to google and whosoever you can.

    IMO this is not worth stressing over. Anything and everything will be shared shortly after (sometimes even prior to) publication. I found my Kindle book on a file sharing site by chance, literally the day after it was available on Amazon. I sent a simple DMCA and went on with my life.

    The book took me months to write, a lot longer than most WSO's. But I'm not going to spend hours worrying about who's pirating my book or what forums/blogs/websites it's being shared on. IMO a VAST majority of the people who steal your content would not have purchased it anyway. A large percentage of them probably will not even read it.

    I'm a believer in the proverb "all publicity is good publicity". Piracy is not something you can effectively stop as a one-man shop, especially without paying a lawyer an arm and leg. Besides, you can find all major films and the most popular books in the world available for download on the net, and compared to us those companies have infinite amount of resources to devote to stopping piracy if they wanted.

    My plan is to just keep on creating more great content, and not focus my limited energy towards trying to get my stuff off of blackhat/torrent/file share sites. Think on the bright side - at least you get your name out there.

    those dmca's may just be going to the person in question. I'd go up the chain. If you run a TRACERT to the domain from the command line on your pc, it will show every hop between you and them - with that, you can begin to track down the abuse addresses of their host, the hosts datacanter, etc.
