"$100 Guaranteed in 30 Minutes" TM

I'm thinking that sounds like a good name for my next product.

You've probably heard about Subway being sued because its "Footlong" subs are less than 12 inches long. Initial word is Subway says "Footlong" is just a name, a trademark, and not a promise of how long its sandwiches are.

These yummy cases are worth paying attention to, as the legal rulings may open the door to product naming shenanigans, or make everyone pay more attention to their product names.

My upsell will be the "$10 Traffic Report" for $15.

    My "truth-in-advertising" pet peeve?

    Potato chip bags!

    You buy a huge bag only to discover that it's barely one-third full.

    The chip companies will tell you the air protects the chips from breakage. But I'd rather have a full bag; I'm willing to suffer through a few broken chips.

    Furthermore, you'll notice the bags are rarely (if ever) transparent. Apparently, it's also important to hide all that air from us.

      The manufacturers of potato chips clearly print the net weight of the chips right there on the bag.

        Actually, it may not be air in the bag with your chips. It might be nitrogen.

        Filling the bag with nitrogen allows the product inside to stay fresh longer, as well as providing a cushion for the chips. When you open the bag, you let out the nitrogen harmlessly.

    Yes some smart Aussie took a photo and put it on Youtube and now someone in the US is going to sue Subway. There is also talk that McDonalds will be sued over its quarter pounder. Some people have way too much time on their hands.

      This is nothing new. I remember a case back in Minnesota, about 45 years ago, when someone sued both a hot dog vendor and the state of Minnesota because the vendor's booth at the state fair offered "foot long hot dogs" that weren't 12 inches long.

      The suit was thrown out, but the next year that booth was pushing "about a foot long" hot dogs...

        while watching shark tank a few days ago. Kevin O'leary was considering an investment and he mentioned something along the lines of the potential lawsuits that the person had, saying he is a master of going after that type of money.



        There's also an affiliate network that search around trolling for patent violations, Essociate for their "virtual affiliate" patent.

        Funny thing is, these people actually make a very nice living off suing other companies. My friend was suing a company due to false advertising and they paid him a lot of money to drop the case.

          Yeah, I hear about these types of lawsuits all the time. It's getting really bad where nowadays you can get sued for anything.

            The worst part: companies are taking advantage of this by patenting simple stuff that aren't inventions (such as a wire through clothing... I saw it in Shark Tank!) and then making companies insecure about creating products with these so called 'inventions'. Patents were great for inventions. It secured people's inventions and gave them credit for it. However, it's horrible in our modern era where you see people patenting generic stuff which leads to genuine product creators not being able to use the idea without paying royalty to the company that patented the idea. I think our legal system needs some updating.

    yeah there are always these sorts of cases...

    Especially with large franchises these things have been offering more and more like when McDonalds was sued because someone burnt their tongue on the coffee, now they have the 'Be Careful It's Hot' on the cups.

    Got an email the other day from a marketer who had "found" a link to a free download for a piece of software. You could upgrade to the pro version but he does everything he needs with the free version.

    Neglected to mention that the free version was a 7 day free trial

    Personally I like being told I can make $100.00 in 30 minutes - now I know what will be a waste of time to buy/read!

    If your product clearly works then it would be worth buying. I would care less whether I earned $100 or $101 in 30 minutes. Though I am distraught to learn that the 40 years I have been eating Double Quarter Pounders from McDonalds may not have lived up to their billing.
