Default YouTube & TubeMogul - User Violation?

Hi Warriors,


I had a fellow Warrior create me 3 x 45 Second videos for
3 separate programs I am promoting.


After creating the videos, the person that made them,
uploaded them to "HIS" YouTube account.


Yesterday I started to upload them to a NEW Social Marketing
site. This was the first and only site that I had uploaded
them too, so far.


Yesterday afternoon I received an email from TubeMogul,
saying my account had been disabled for spam. So I contacted
them, pointing out I hadn't used TubeMogul in about 2 months.
They replied saying it was due to content violation, but
wouldn't be more specific.


I then checked out the videos on Youtube....and got this
message;


"This video has been removed due to terms of use violation."


What I can't understand is:


1. Why Tubemogul disabled my account, when I hadn't even
uploaded the videos to their site and the fact that they
were NOT on "MY" YouTube page anyway, they were on the page
of the person that created them.


2. Why ALL 3 Vidoes were deleted, especially as they were
for three different programs.


The only reason I can think of is this...


Is it classed as Copyright Infringement to SHOW parts of the
website you are promoting in the videos?


My videos were simple Flash movies with music, scrolling
text and various parts of the website coming into view,
highlighting main points, like testimonials etc.


I really don't think the owners of the programs have
complained, for one it would be highly unlikely to have
three of them do it, at one time and I have seen the
actual "company" videos modified and put on Google and
they are still their.


This has me completely baffled and I can't even upload the
videos to other video sites now for fear of having those
accounts shut down


If anyone has any idea why all of this would be happening,
please let me know.

By allowing this, you have, implicitely agreed that the copyright is owned by that person. Once you tried to upload them they failed the 'original all my own work' test and got flagged as (at best) duplicated content or (at worst) gross copyright violations.

You are now in the position of embedding the code to display 'your' videos on your site (if that is allowed) or referring people to YouTube to watch them.

You might not like what I say - but I believe it.

Hi successpro,

My suggestion is, Read the rules of tubemogul and youtube. They don't banned you if you don't have violations. I'm sure you have a violation, its better to revise your video or maybe you video tags.

Hi

Good point about YouTube thinking that the copyrifht belonged to the person that created the videos, but it still forsn't answer the question as to why TubeMogul closed my account....I didn't even try uploading the videos to their site.

Thanks, I have read TubMoguls terms, but as I mentioned before, I didn't upload anything to TubeMogul, so I can't see a reason for them closing my account

They consider the videos duplicate content when they are already uploaded to other accounts.

Another words it is under the assumption that the person who uploaded the videos owns the intellectual property rights to them. So when you try to upload the videos to other accounts, your accounts were flagged for violation of copyrights.

Just have the guy who made the vidoes delete them from their Youtube account and upload them yourself to your own new account.

I can appreciate what everyone is saying so far, but this has not been my experience with YouTube. I'm a video producer and sometimes I'll upload a client's video to my account first to see what it looks like on YouTube.

I use a different title and tags from the client but otherwise the videos are the same. Never had one removed from the client's channel.

Judging by your sample, I expect YouTube removed it because it includes an image of Homer Simpson. Don't know how that relates to the TubeMogul problem.
