How can I tell if it's ok to use this Modeling pic of this girl for my ebook cover?

Hi guys,

I have an ebook that I want to release and I need a picture of a hot model (attractive girl) for the cover but I don't want some photographer or the girl herself to track me down a year from now to say "HEY! I didn't say you could use that!!! See you in court..."

How can I tell if some of these pics are google are safe to use?

What I have been doing is:

  1. going to google
  2. doing an image search for : female models
  3. then going to advanced search and selecting only "free to use/share, modify or even commercially"
  4. the finding a flicker site
  5. finding the photo i like
  6. then clicking on the photo rights that and finding one that says :"
You are free:

  • to Share -- to copy, distribute and transmit the work
  • to Remix -- to adapt the work
  • to make commercial use of the work"

Am I ok? Is this ok for me to do? Need some legal help.

Thanks!

JT

Are you going to be using the ebook for commercial purposes? I'm guessing you most likely are. There is a box for "use commercially" in the Flickr Creative commons area. If you want to be super safe, just buy an image on Thinkstock or another stock photo site, they protect you in court if anything ever arises, up to 100k in insurance for just that thing.

    Hi
An IM forum is not the best place to ask for legal advice...
Just fork out a couple bucks and buy an image...

I wouldn't rely on Google Boolean logic if you're legality is on the line.

Much better is to use a legit stock graphics source (which often have a guarantee) to ensure you have legal access.

What sounds more legit; you used a legal service (like shuttstock, 123rf) to purchase stock graphics and they guaranteed rights, or you searched with Google?

Food for thought. I'm not a lawyer.

Purchase a cheap graphic from one of the photo sites that allows you to use for commerical purposes. No chances of ending up in court.

Yeah it really is the smart way to go, you can recoup that investment on the sale of your first ebook. Find some microstock galleries out there and save the potential hassle. If you really want to save money, launch without the girl on it and the first couple sales put that towards the graphic and re-brand the remaining sales

You could always go on a stock photo website, that way there will be a license so you'll know for sure if it's alright. Stock photos are cheap too, and you'll have a better selection.
