Images in a youtube video

I hope this is the right forum, I reviewed all of the forums and this seemed the most appropriate.

I am making a you-tube video, the characters walk by a movie theater. In the background there are movie posters that have copyrighted images on them. The images will show on the screen repeatedly as the scene takes place in front of them but has nothing to do with the images specificly.

Is this allowed on youtube? is it allowed to be monitized?

    I don't see that as being an issue if it's just something in the background of the movie. This type of thing happens all the time on the news and even other movies.

    Always best to consult a lawyer though because you are the only person with something to lose from bad advice.

    Unless a copyright lawyer answers your question, any answer you get will be from people who have no real qualification to give you that answer. The real question is, what are you going to do either way? Will you post your video if the majority here says go ahead and do it? Will you not post your masterpiece if this thread fills up with "don't do it" answers? The short version is, don't wait for your movie to gain traction, only to have it pulled.YouTube movies get pulled when a copyright owner files a claim. Thus you can either ask a copyright lawyer to see if odds are in your favor, or contact all the copyright owners that you feel may come at you later, or how about re-shoot that scene? Can you blur out / replace the posters?
