Fiver will not give me my money back

I purchased writing and box shot gigs from fiver to the value of $75 the seller had one of their best gig ratings so I ordered. As we went passed the deadline, I got a message saying that they were expecting major power cuts in his Indian city and that he was very busy (as far as I could see it was only my orders in his queue) and that he wanted to cancel my order.

As you can imagine I was very annoyed as I was waiting for these articles for my site - but never mind nothing is perfect in life and I decided to go back to iwriter.

So I asked Fiver support to return my money to Paypal so I could buy my new services - NO RESPONSE.

So I then posted on their community board - was told off by the Sherriff was naming the bad seller and then he says unless I earned the money on Fiver it would not be credited back to my account.

Another user posted that if I tried to get my money back via paypal dispute my account would get cancelled (seemed to be inferring that my Paypal account would get closed) and not my Fiver account.

Then they removed my post

So let’s see what Paypal has to say and please, please ignore Fiver's rating system it is easily manipulated and means nothing.

In fact it seems to me that if a seller is new they are more likely to make more of an effort.

Kind regards

I tried to get a refund from fiverr also, once. I sent about 5 emails and never got a response. I won't go there anymore.

Money you send to Fiverr to BUY a GIG can't be withdrawn, it's in their TOS.

You can cancel a GIG which apparently was offered to you by the seller, what put's the money back into your Fiverr account so you can buy another GIG.

The seller was fair and told you about his problem, can't see what this has to do with his ratings not been OK. It sucks when you wait for a delivery and the seller never delivers - what was not your case as far as I can see.

You can only withdraw money you generated as a SELLER in Fiverr.

Even myself as a seller, with money in my seller account, I can NOT withdraw money I have in my BUYER account which I send to Fiverr for purchasing GIG's.

No chance you win a dispute here - You just miss knowledge of their TOS.

The seller cancelled because he did not want or need the work - it's as simple as that.

Complained to Paypal and if I do not get my money - out comes the Article Marketing Robot - I hate being scammed and would not do it to anyone else

On checking more I see his cancellation rate is 45% and people like this should be removed from the service this didn't show up until the new version kicked in and I would have never had purchased in the first place

The second seller claimed to be an expert graphics designer to do my box shots - I even sent her samples and logos of what I need - she sent back something that would have looked good if I was a hippy in the 60's when I complained and told her again what I needed.

The response was that it was to much effort and she cancelled.

TOS cannot legally be upheld for work cancelled by the seller and the buyer was scammed

I see and feel your pain as I also purchased GIG's which didn't deliver (logo design).

Fact is that the money is not lost for you when a order got cancelled.

And orders delivered which are simply crap can be disputed within Fiverr as far as I know.

What I meant was that you agreed with your account setup that transferred money into your Fiverr account can not be withdrawn.

I don't know if that can be done when you cancel your Fiverr account. You have to take a look at TOS for this.

You should have checked his cancellation rate first.

Regardless Fiverr is going to have it's share of bad giggers. Why not accept the cancelation and use the money in your account to buy other gigs over time?

There will always be buyers like the OP who buy stuff without reading TOS and then cry about it afterwards. That's just part of selling online and you have to take into account fraudulent Paypal disputes as just being part of business.

I found this answer really offensive and unhelpful, no one likes getting ripped off and I wanted my money back simple as that - requesting Paypal to help one of their customers is not a fraudulent claim

what makes it worse is your huge advert link trying to attract customers saying money back anytime.

Will any of your dissatisfied customers get any money back or do you have your own TOS to avoid that?

If the seller offered to cancel the gig, then what is the issue? Some folks have things come up that interfere with their ability to deliver. Your money will be credited back to your fiverr account.

I am thinking that you maybe threatened fiverr on your first contact, because I have never had a problem getting a refund.

I have a 3-month old Fiverr account as a writer-seller (No, not the one in my signature below). I had one instant that I requested the buyer to cancel her order because I had a personal emergency . The buyer understood my situation, but it reached my target submission date (2 days) before she was able to cancel it. I did not receive any negative feedback probably because I immediately informed the buyer, just hours after she ordered.

And yes, @bwh1 here is right, Fiverr TOS says, "Fiverr will not refund payments made for cancelled orders back to PayPal. Funds from order refunds are returned to the buyer's balance and are available for future purchases on Fiverr."

You can read it here: General Terms - Disputes http://fiverr.com/terms_of_service

I also read some debates/complaints on Fiver's rating system, but Fiverr stands firm that "Top Rated Sellers are chosen manually by Fiverr moderators from the list of the highest seller level based on a list of criteria, including seniority, volume of sales, extremely high rating, exceptional customer care and community leadership."

However, the fact that you said that the seller has "one of their best gig ratings" and "his cancellation rate is 45%" makes me wonder. No offense, but if I am a buyer, I will not order from a seller with that high cancellation rate.

I still consider myself as a newbie in Fiverr, and I'm still observing them. But so far, I am just happy that I have regular clients from them

Paypal won't help you. While many people will claim Buyer Protection, they do not cover Intangible Goods or Services (Fiverr's entire business model...) as explained at https://cms.paypal.com/us/cgi-bin/?c...20for%20Buyers. specifically 13.3

Yeah, pretty much this. Sorry to hear about your bad dealing on Fiverr (how is it no one said anything about 'you get what you pay for' with $5 dollar freelancers in this thread?), but any dispute with Paypal is likely going to go no where.

I can recall an instance where I paid $500 for a piece of software (this was a yearly fee). Mind you, this software had remote licensing validation. Meaning the company could invalidate my license if I did not renew and the software would not work.

Anyway, software was complete garbage and didn't function anywhere close to what was advertised. I tried to get a refund, company told me to go play in traffic. I contacted Paypal and filed a dispute and Paypal said "Take your digital product and go play in traffic."

Guess that's a long way to say, "Good luck with your dispute."

In a educated and polite way, yes.

I lost a few weeks ago my level as I posted a link to WF in a message to a potential buyer.

Took 1 day for Fiverr support to come back and set things straight, just was asking polite to reconsider the downgrading.

I just mean that I could see the initial post from OP where he screamed out the word "scam" in the title right away without knowing the facts of Fiverr's TOS.

That way you kill your chances to get a fair chance of resolving issues.

      G.

P.S. not saying that OP did this - OK.

    1. I did not see the 45% cancellation until the new version was released or I would have never purchased and he only cancelled after the projects were due.

    2. To be told by the box shot women that it was just too much effort after the project was due was really annoying.

Both these people had good ratings - why would I not buy?

    3. There seems to be at least one person on this post who I would suspect is a Fiver reputation manager.

    4. There are several people here that have given the "So What" answer" buy other gigs and my response to that is at the moment I have lost faith in Fiver to deliver and would rather go to iwriter or someone similar.

Next they said you haven’t lost anything - I have lost a total of 3 weeks on a time sensitive project and until get my money back I will continue lose real money.

As for Fiver if anyone had pulled this TOS crap in a USA regular shop instead of an on-line business they would have been in real trouble.

I said on the Fiver forum I do not care if my account gets banned and the response was that they track ip addresses and once banned you are banned forever - take note.

But Fiver has not pulled the TOS card out of the hat, that info came from here (reputation manager) and their forum board - What they have done is ignore my support request - had they actually replied I would probably never have posted anything here, on their forum or any future articles I put out.

    Kind regards

The Fiverr TOS issue aside, you can't tell me that you're really surprised that a $5 dollar freelancer or two flaked on you?

Just a suggestion, but if you don't want to deal with flaky freelancers, stop looking to pay bottom dollar for your outsourced work. Look for higher quality people to employ and pay them what they're worth.

      I particularly liked this bit

The really bad part is you can't leave feedback or a rating if the gig is canceled by the seller, automatically by Fiverr for not completing or due to a dispute. Which makes a 100% gig rating sorta worthless because you don't know how many gigs the person never completed. Even worse, how many ended in disputes. I'd love to see those stats shown to buyers.

Maybe Fiverr will work on the rating and feedback system but I won't hold my breath.

@smith, i am seller myself at fiverr and a buyer more.. which is the biggest irony .So this is how it works with fiverr. When you purchase from fiverr as a buyer and cancel a order, the amount is being credited to your buyers account and you can't withdraw it. All you can do is used it for further purchase which isn't fair at all from buyers point of view. Secondly, you can only withdraw the amount you have earner selling gigs. Now, if you raise a paypal dispute, the seller is most likely to get suspended for a while as what i have seen in their linkedin group conversation. Their support sucks, when you approach them as a seller, it would seem like they are very loyal to their buyers and when you will approach them as a buyer, it would seem like they are loyal to their sellers. So at the end they are at no-one's side, play unfair and try to make money from both the sides and that's what they have been doing it so far.Since, you raised a dispute, so hopefully you will get the moneyback but all depends on paypal.

You do realize that 99% of businesses that sell physical products are just Offline Affiliates, right... They don't make those products, they just provide the space to show them to local customers, and they take their cut of each sale.

The real problem is that your worried about $5. If $5 was such a huge investment, why did you waste it on Fiverr in the first place? That's like trying to get a great deal on a "Brand New Gizmo!" and trying to buy it at a yard sale... Seriously, logic says you should smack yourself for being naive.

Call your friends, family, or even a neighbor. I'm sure one of them would be willing to dig you out of that huge hole by lending you $5... Or did you just want to keep this self pity party going a little longer?

    Hay,

As far I know and experience you do not need to either ask fiverr or do anything. If the seller does not meet his deadline as stated by him on his gig then Fiverr automatically gives you an option either to Cancel the order or contact the seller.

If you cancel the order, the money will be deposited into your account and will be used when you buy another gig.

I have personally experienced this, when some of my seller does met the deadline I have cancelled the order and my money was adjusted when I ordered new gig. But you need to wait till the time seller has given in this gig.

Fiverr is safe to buy as you will not loose your money and seller has to provide the work well in time. If he does not then Fiverr gives an option to cancel the order.

Hope this would help, if in case you do not get this option then I hope you need to contact Fiverr.

I successfully put in a a PayPal laim for a cancelled Fiverr gig once, and won. Fiverr threatened to cancel my account with them though. In the end they didn't, but they might if I tried to do it again.

In Australia it's law that;: if you purchase a product or service and it wasn't delivered, you are entitled to a full refund. These TOS would not be binding in my country, and they also shouldn't be anywhere else.

I really don't understand what the OP's issue is with either Fiverr or Paypal. Sure, in any marketplace, you are going to have good and service providers. And I use Fiverr as a buyer regularly. Not all gigs go the way I want them to. But you know what?

That's part of the game. For all of us.

The problem isn't that Fiverr is at fault for not refunding you back your payment. The problem is people not reading the Terms of Service beforehand, and that fighting the TOS once an issue arises.

The OP didn't lose his $75. It' still in his Fiverr account, ready to be used. They have a policy about not refunding money back to buyers, and they plainly state it in their TOS.

Although their are scam artists and poorly run service providers on Fiverr, they are also found on the Warrior Forum, and any other marketplace for that matter.

So my suggestion to the OP: stop whining about not knowing the rules and just move forward by ordering new gigs from other providers.

Yes, this isn't a perfect system. But we ALL have to play by the same rules as the OP.

    JoeMack

P.S. There are PLENTY of amazing service providers on Fiverr.

I got the same situations. Money for not provided services were credited to my buyer account.

Lesson learnt: Never buy gigs for more than $5.

Why do you find his reply offensive, he is just stating the obvious in which you didn't read the rules, the claim would be technically fraudulent.

I for one would not like to see Paypal resolve this issue on your behalf because if it does, it would just make all TOS'S null and void and anyone would just be able to ignore them because they would feel confident that Paypal would be on their side.

Nothing against you personally but rules are rules, learn to completely understand them.

What does Chase's signature have to do with your issue with Fiverr? His signature does state that he would return your money back at anytime, so he in fact would be inclined to do so.

On the other hand, Fiverr at has never stated such on their website.

A lot of TOS'S should be null and void too many scammers hide behind them.

This post would have never even been put up if Fiver’s response team had responded to my request for assistance.

Fiver are hosting sellers that just want to pick and choose the projects they want to work on - it would be like an IM Coach taking someone’s money and saying I do not want to teach you because I am doing something else or simply cannot be bothered - but you could use the money for a later course, should I choose you but don’t get upset because my shops TOS say that I can do this or you could try out someone else in my big shop and see if they are any better.

This is no reference to Chase, I have no idea who is or if he is any good, but if his major selling point is - If this is not working out for you, you can cancel your direct debit at anytime, I would not choose him to mentor me.

I am a little disappointed by your stance given your senior status on the forum and felt that if you could not have been more constructive then you should not have posted.

The major value of this forum is to help members and if I can point out where I went wrong and stop someone suffering the same fate – I will do so.

If I do get a refund I will publish it on the forum so others can see TOS’s should not be used to hide bad business practice.

You are missing the message that most of the replies are trying to convey which is Fiverr has terms and conditions that a user will have to abide to, are they fair maybe not but those are the terms.

I don't like the idea of not getting my money back either if I was in your shoes but if I know that going in then there is not much I can do but accept their terms.

Just because you don't like a sites terms does not constitute them being a scammer, you either accept the terms or don't use the site, simple enough.

        Wow...

This thread started as a self-pity party and it's only getting worse. Your blaming Fiverr and Paypal for your lack of common sense. You didn't do the research and read their ToS, and now your angry because you made a mistake.

        You have two simple choices.

        1) Grow up and move on with your life. This was a $75 lesson, and hopefully you learned from it.

        2) Give up in the Online Business world, and find yourself a 9-5.

I suggest #2 for you. Why? Because you don't have the proper mindset to run your own business. You think you can make up your own rules and have everything your way, when it wasn't your playground to begin with.

        YOU went to Fiverr.
        YOU didn't read the rules.
        YOU made the mistake.

Stop blaming people for your mistakes.

I really hope a moderator comes in here and locks this thread. It's getting to the point where it's just the same crap over and over, and I'm sure people are sick of seeing this useless thread at the top of the forums.

It keeps on getting a response from me because of posts like yours

          1. I do have a day job and my team and I do deals in the Insurance Technology markets for deals up to $23m - I get paid very well.

          2. I make money online - not as much as I earn from my day job but nearly. I do it because it is a fun hobby and I enjoy it not because I need to.

          3. I have a very good business mind set and do not like to throw money away and neither do our clients and by focussing on their needs and making sure they are not wasting money - we are very successful and the same style works well in IM.

          4. I normally write my own content but was busy so I went to Fiver for a try out – the content was non starter but the videos have been brilliant.

And finally every hater seems to be missing the main point I was trying to make - Fiver's support has simply ignored my support requests and that what made me reach out, that is not unreasonable or wrong.

I've gotten a refund from Fiverr before. Customer support got my refund back to me within 48 hours. I think their customer service is pretty good.

Why would you bother with articles from Fiverr, when you can get quality here on the WF?

There are some good sellers on Fiverr, but when it comes to content, graphic and SEO, I tend to stay away. The thing about the warrior forum, you can't manipulate ratings, you can kiss ass, but if a warrior does bad work, you can always post about it in his sales thread.

This is a quote from the Original Post.

    1) You ordered gigs.
    2) The seller canceled and your money was refunded to your Fiverr balance.

Your entire argument is that Fiverr won't put that money back into Paypal, which is AGAINST THEIR TERMS OF SERVICE.

Is it Fiverr's fault that you didn't read their terms that YOU AGREED TO when you created your account? No, it's your fault.

So how is crying about your mistake on the Warrior Forum going to fix it?

It's amazing how people can complain about their own mistakes and blame them on other people over and over, even when all of the evidence is against them.

You're not special. You don't get your own set of rules. If you don't like it, don't use Fiverr. But don't come running to the Warrior Forum hoping that people will pity you just because you made a mistake.

It's time to grow up, move on, and not make the same mistakes. Or, you can continue to make the same mistake and costing yourself money and time over and over again. It's up to you, but don't complain to us about Fiverr when it wasn't their fault to begin with.

yeah man, fivver is the place where you go to gamble on your marketing to see what works. Start small, $5, and see who is legit.

Then you can order more from that vendor if they deliver. You don't drop $75 on 1 vendor that you've never used before.

So you got burned and are feelin bitter. Best to just move on and chalk it up to experience.

Now you're wasting the most precious resource of all, time.

Same thing happened to me once. Someone bought my gig and I was completed that and waiting for their confirmation and they never returned back and the gig got delayed status or something, and later what I saw was the order got cancelled and disappeared. I did the work but received no money... I think their system is not correct.
