I am working on setting up a JV with a company (not from this forum). One of the things this company is bringing into this collaboration is a list. This is a list of paid members for a site the company owns.

It all looks legitimate, however, as part of the due diligence process, I want to test a small segment of the list. I wan to email this list an offer in the same niche and check the results.

Of course, there is always an outside chance that the company who approached us misrepresented the facts about this list. My question is: how can I test this list without getting into trouble if the list is actually not what it's supposed to be. I don't want to run a risk of being banned for spamming.

Anyone can suggest the safest way to do this test?

You can use a service that will email for you. Plenty out there and just search, insert a few alias emails throughout the list to make sure they sent it.
You can also employ someone from fiverr to do it for you.

Perhaps you could send a quick email to a small segment asking a quick question like:

"hey, do you remember how you signed up to this newsletter?"

      or

"hey, do you remember your first experience with us?"

or something else along those lines.
