I just created my 1st digital product (An Ebook). I will probably get a copyright for the ebook, but was wondering if you also go farther and TRADEMARK A pretty catchy product title? Since its my 1st time doing this, if you could give your opinions on what would be best to "protect" my ideas I would appreciate it. I know a lot of "borrowing" or outright theft can occur online and some can't be avoided. Thanks Guys! I appreciate your help! Sheila |

Could you imagine yourself wanting to sue someone for monetary damages if they used your name? If yes, then get a trademark.

Thanks! I just am not sure what the NORM is for digital products. Do most people trademark the book names, probably not I am guessing.

Registering a trade mark is a good idea if you are going to create a series and want them to have a corporate style. It is not usual to be able to register a commonly used phrase as a trademark so the book title would have to be a unique order of words. As far as copyright goes, if you wrote the ebook you own the copyright. If you want to be able to prove copyright ownership at some future date, post a hard copy of the ebook to yourself by recorded delivery and retain the postal package, unopened, in a safe place. If a copyright issue comes about, you can prove, beyond a doubt, that your original copy was owned by you on the date on which you posted the package to yourself. Just make sure nobody opens the package until you are in the court room disputing the case - and even then, make sure it is opened in front of the two atorneys and the judge. |

I think you mean can we "copyright" our website. I BELIEVE....that all you have to do is say at the bottom somewhere Copyright 2009 C and that C symbol for copyright....that will copyright your site...but i think you can also copyright it at the copyright office for $35 or $45 w/ an online or paper format. I don't think you can "trademark" a website. |
